Hello Legalfalcon,

I just found out after talking to my father today that he tried to apply for permanent residency for Canada where I was included as a dependent and he got a refusal. The refusal came in 2007 according to him. He never mentioned this to me before until I asked him about it today. He also tried to apply again through a lawyer but he has no idea whether his application is submitted or what happened to it.

This is really scaring me because I have been answering the question about visa refusal and such in all my application: study, work, visitor and PR as "No" cause I had no idea. Obviously I sent a CSE again. I am really scared with all this CSE and security being already done I will be rejected for misrepresentation. When you try your best to do it right and this is what happens.

What do you think is going to happen? Will I be rejected?

Thank you for your reply Legalfalcon. I panicked and sent them CSE. I have waited for PNP for around a year and now waiting for PR for more than a year and I really don't want to go through this difficult journey again. So I am making sure my application is solid. If I get PR I just want to have peace in mind knowing there is nothing wrong with the way I got my PR.

You will receive the certificate by post. Don’t worry you’ll receive it before you submit your e-APR. Also upload Schedule 4.
thanks for your reply imxty. But can u tell me after how many days did u receive the post from Ontario? was it by courier? Or can i proceed with the the confirmation letter that i got from CIC itself and attach with the ITA documents?

I got it in 2 days. Nomination on Tuesday night, got the certificate on Thursday evening. I live in SG.

Not sure if you can upload the letter from CIC account since I uploaded my certificate. Maybe you can raise CSE later when you got the certificate, or CIC will send you an ADR for it.

Police certificates are required up front and are mandatory for each country (except Canada) where an individual has lived for a total of six months or more. This instruction is for the purpose of the completeness check under section R10. However, it is always at an officer’s discretion to request a new or additional police certificate.
I'm concerned about this, as I was under the impression that the requirement for PCC was for either the last 10 years or since the 18th birthday. I must have confused it with the Travel History requirement. :(

The country I'm worried about is my home country, which I used to travel to occasionally but I have not visited for the past 10 years or so.
As of now, I'm still not sure if my travel history will add up to more than 6 months since my 18th birthday, so I am going to go check if I still have my older passport(s) from that time.

But in case that my total time adds to more than 6 months, what action do you think I should take? Do I try and get the PCC as soon as possible and update IRCC with it? Is that possible, and will they accept that?

I am currently in NA2 stage of my application.

Thanks for your advise in advance.

now Im a little worried...I even mailed Ontario asking for a copy by email..but i think they only send post...does it come by courier?

Hello Legalfalcon,
I was going through my OINP application and I found I answered 'No' to this question:

"Have you, your spouse or common-law partner, or any of your dependent children, already submitted or been included in an Application for
Permanent Residence to Citizenship and Immigration Canada (CIC)?"

Since I already sent CSE about not mentioning my father's PR application refusal where I was dependent for my Express Entry PR submission, do I have to also inform them about this mistake for my OINP application? I used my OINP nomination to get ITA hence worried.

My application is submitted and in progress, How to amend it?
If you have submitted your application post ITA you cannot amend it. However, you can raise a CSE and send updated PoF.

41 A person is inadmissible for failing to comply with this Act

  • (a) in the case of a foreign national, through an act or omission which contravenes, directly or indirectly, a provision of this Act; and
(b) in the case of a permanent resident, through failing to comply with subsection 27(2) or section 28.

This is what s41 states. However, to ascertain what is exactly relevant to you, can you post the relevant part of your GCMS notes.

If you have lived in your home country for more than 6 months, then your should get a PCC and update ASAP. If you have not, then no need to worry. If you are unsure, then better to have it then not.
