Hi @legalfalcon ,

My AOR is may 15th CEC

Medical and biometric completed

Security and info sharing - in progress

Eligibility - not started

Criminality - not started

I'm worried about this status. It feels like my application isn't moving. Is this normal?

many applicants around my aor dates have received their pr.

Also, could this delay be due to the country the background check is being done on?

Thanks

This is very normal. Most of the processing happens near the end of the 6 months time frame. You can request your GCMS notes, and see more details. Een if your eligibility is not passed, there may be some notes for it. Only after eligibility is passed, does the security start.

This is a general search that IRCC did and pertains to your identity verification, in which IRCC found no concerns when they ran your names on the database.
Hello legalfalcon,
Thank you so much for a prompt reply.
I have another query that I posted before.Please guide….
I received my valid job offer in Sep 2021 and based on that I got nominated for Alberta PNP and started my PR process in Nov 2021.Meanwhile in 2022 since PR process was taking long due to COVID backlog my consultant adviced me to file a work permit. So in March 2022 I received valid work permit for 2 yrs.Now my employer says that I should come on PR only.My PR application is still in process…
I am the primary applicant my tracker shows all the parameters complete but my dependent BG is still under process. It is already 21 months since my PR was filed.
My queries are:
As already WP is issued to me ,could this be a reason for my PR delay? Can IRCC hold my PR case for this reason?
Secondly shall I wait for PR because I want my family to accompany me to Canada and things would be easier together or I should go on WP alone.
Your guidance would be really helpful. Thanks in advance

1. If you receive a COPR as an inland, you do not need any landing formalities. Your COPR will be signed and effective te date on it, you will hold a PR. If you are outside Canada, then you have to show up at a port of entry and upon being processed, you will attain the PR status.

2. You can travel to any country and return as long as you have a valid Canadian visa or status to return.
Hi,

Thanks for your reply.

"2. You can travel to any country and return as long as you have a valid Canadian visa or status to return. "
Does this mean that even after providing the last entry details and the 'present inside Canada' declaration in the COPR portal, can I travel to the USA and be back in Canada later? Is there any condition like one should be physically present inside Canada when the eCOPR document is issued ? And, even in case if I travel only during weekends while waiting for the eCOPR, it'd be contradicting the last 'entry date' mentioned in the eCOPR and does it pose any issues ?

Thanks.

There are a number of things you can do.

1. employment offer outside QC
2. show your address outside QC
3. utility bills outside QC

However, this is a very critical step so don;t take it lightly. If you reside in QC or IRCC has any clue that you may not move, your application will be declined. Also, do not lie. If you do not have any intentions to move out of QC, go for a QC PNP. But do not lie.

And if you want to go deeper into this issue, the following federal court cases are a good starting point:

1. Luco v. Canada (Citizenship and Immigration), 2018 FC 248 (CanLII), <https://canlii.ca/t/hqsmq>
2. Dhaliwal v. Canada (Citizenship and Immigration), 2016 FC 131 (CanLII), <https://canlii.ca/t/gn7xb>

The above cases are more on the lines of people who were studying in QC and wanted to move outside QC after getting their PR. Nevertheless, these are a great starting point.

@legalfalcon Thanks for the valuable suggestions.

I am working remotely so i have asked my employer to send me the below mail text .

  • "This is to certify that Mr A who is an employee of Company A and working for Company B,Montreal (Company A's client) may work from other locations (outside quebec) in future to work remotely or from Company B, toronto office "

  • Along with that i have asked my employer to raise the work permit extension for toronto.

  • Also i am planning to attach proofs of the job applications which my wife is applying in ontario area.

Would these things make my intentions clear ? Please suggest.

Hi @legalfalcon! I'm an FSW inland applicant. PVO Ottawa SVO Etobicoke. All completed on tracker since June 14th. Final decision June 10th. Haven't had an update since. I called them yesterday and they said it's taken longer than usual but still within 5 months mark. Any idea in what stage my application is/ and why is it so slow after "decision made message" on GC Key?

Hi @legalfalcon,
Expanding on this answer, would you say it is possible for my company to provide me with a valid offer letter (that can be used for the 50 points), if if my current work visa/offer letter is ICT and LMIA exempt. Would they be able to get another offer letter that is LMIA exempt if it is a transfer within Canada? Or does that exemption is only valid internationally?

Thanks.
Hi @legalfalcon,

Can you please clarify this doubt for me ?

To get your eCOPR - you need to have declared your presence inside Canada. Once you have been issued your eCOPR (and while waiting for your PR Card), you can travel outside of Canada however, to get back in, you will need either a PRTD (which can take 30+ days in some cases) to travel by Air, or you can cross back into Canada via US/CAN land border.

Hi,

There is a slight misunderstanding here. I did not receive my eCoPR yet. I have declared my presence in Canada and submitted details like photo/address in the Permanent Residence Portal, but my eCoPR has not been issued yet. My doubt is if I can travel to the USA and come back to Canada while awaiting eCoPR.

Hi @legalfalcon , my criminality was passed but as my eligibility passed, my criminality went back to not started. Is this normal?
If this is as per the status on your MyGIC, yes, this is normal, and I am guessing you are referring to BGC?
