Good evening Sir Falcon. Could you please clarify on thing. I applied for PR under CEC, I have a LMIA expiring soon April 21. Claiming points for this job. Do you have to keep working in this company after my LMIA expires? I have received a BOWP valid for one year, Marc 22. I tried to find the answer on the website but I couldn't. Thank you very much @legalfalcon

If you claimed 50 points for arranged employment, then you will have to continue working for the employer who give your the arranged employment offer letter.

Hi, expert. My application seems to be going to be complex. My office looks like be in transit from CIO to notorious Etobicoke because of eligibility. My secondary office was Ottawa in the previous GCMS note. It is Etobicoke now. File transferring has started on Feb/02, 2020 when my medical was passed. By the way, the file is not arrived at Etobicoke yet for over one month. Please advise. How long does it take that the file arrives at local office?

https://drive.google.com/file/d/1eMD11yaAhc8MIT26Tt6IpPvspIXEEZZX/view?usp=sharing

This is my timeline (OINP International student with job offer stream, all inland)
MAY/19_2020 - Application Received (AR)
DEC/08_2020 - Acknowledge Of Receipt (AOR)
DEC/17_2020 - Biometric done
DEC/28_2020 - Upfront medical
DEC/30_2020 - Received Medical Request (MR)
Feb/02_2021 - Medical Pass
Medical/Criminality pass, Eligibility/Security not started.
Hi, @legalfalcon
Can you give me an advise? My paper application goes to Etobicoke office from CIO? Thanks.

@legalfalcon I received ADR for two things
1) RCMP 2) RPRF.
The request letter stated :

This is in reference to your application for a permanent resident visa. The admissibility review is
currently in process; you will be contacted if additional information is required for that purpose.

My question is : can i assume that eligibility is atleast recommend passed?
Also is admissibility review different than eligibility?
How long to expect PPR?

Thanks

There are different kinds of admissibilities:

Criminality
Medicals
Security
Human Rights
Financial
Misrepresentation

Will depend on what admissibility are you referring to. Simply put each applicant has to be admissible to Canada based on the above. To know about your eligibility, you will have to either specifically ask about the status of eligibility, or see your GCMS notes.

See https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/inadmissibility/reasons.html

@legalfalcon Question about police clearance. I was working in Afghanistan for US company, in military base, for total 5+ years, but never stayed there more than 6 months in row. Do you know what police clearance I need to get since on document check list I have to provide from Afghanistan? Basically I was working on american soil.

As per IRCC:

  • For the applicant’s current country of residence, the police certificate must have been issued no more than 6 months before the submission of the e-APR.
  • For countries in which the applicant no longer resides, the police certificate must have been issued after the last time the applicant stayed in that country for 6 months or more in a row.
  • Police certificates meeting the above requirements can be accepted even if they have an expiry date that has passed.
  • This includes the requirement to provide a police certificate for countries in which the individual has travelled for 6 months or more in a row, whether or not the individual had an established residential address during this time.
  • Police certificates are required upfront and are mandatory for each country (except Canada) where an individual has spent 6 months or more in a row within the last 10 years. The individual does not need to provide one for any period of time before the age of 18.

This is standard language. "Proof of funds: sufficient documentation on file to support PA including DEPs"

i.e if you may have any.
Thanks for your reply @legalfalcon
Usually, will all applications be checked for A39-A41? Does this check apply for all applicants? or is it applied for certain cases?

Another question, usually when an applicant passes the last stage which is security, what would the officer usually writes on the GCMS notes?

Best Regards,

Thank you @legalfalcon, but since they requested for RPRF , i was assuming that eligibility could have been passed.
When RPRF is requested, it could be either the eligibility is recommended passed, passed or awaiting an officer's review.

Yes, all applications have to go though A39-A41, but it will depend on the officer based on the circumstances of the application where a specific check is required or not.

Security is done by CBSA / CSIS and other partner agencies. They submit a report to IRCC, based on which IRCC will make a final determination. No note is added to the GCMS notes, except that page 2 of security says passed in GCMS notes obtained form CBSA.

Hi @legalfalcon I have a question, if you don't mind.
I received my COPR in December 2020 (FWS-O). I currently live in Brazil and I don't have any relatives in Canada.
I saw in the "find out if you can travel to Canada" tool that it would be possible to enter Canada from USA with approved COPR.
So I am thinking about traveling to Mexico to quarantine, then go to the US and in the next day fly to Canada.
Do you think it is possible? I have US tourist visa.

Thank you very much in advance.
All the Best

You have to be a US resident. You can try, but whether to admit you into Canada or not will depend on the CBSA officer at the port of entry. Unless you fall under an express exemption and have an authorisation letter, it will be difficult.

Alternatively, you can call CBSA and enquire.
