Dear Sir,

Hope you are doing well. I wanted to ask you a question about proof of funds and submitting funds from accompanying spouse's bank account. I have submitted my PR application and under POF I have submitted 2 bank letters, one under my name and one under my spouse's name (accompanying dependent) along with 6 months statement for each of the 2 accounts. We don't have joint accounts and her account is separate and mine is separate. Do we need to submit any other proof? I read somewhere that the primary applicant (me) needs to prove that I have access to my spouse's funds in her account. How do we prove that, and do we need to prove that is the spouse is accompanying you? did anyone you know submitted something similar? Looking forward to your reply and learn from your experience.

Thank you in advance
Regards.

If an applicant’s spouse is accompanying, the applicant can show the funds held together in a joint account to meet the PoF requirement. However, to be able to show the funds for meeting the PoF requirement, held in an account under the spouse’s name only, the applicant must prove that they have access to the funds. This can me done by the spouse executing an affidavit affirming that the funds held in the spouse’s account can be used by the applicant for the purpose of meeting the PoF requirements.

Similarly, if an applicant has a joint account with their parent, then the parent will have to execute an affidavit affirming that the funds held in the joint account can be used by the applicant for the purpose of meeting the PoF requirements.

Hi @legalfalcon

Thank you for your reply. I did in fact finally receive my GCMS notes today after 50 days, and it’s true about getgcms. The team there was very helpful and raised a complait to IRCC.
That is awesome! Hope your application is progressing well!

thnx for ur reply,

so what should i do now? provide CIC the bank statement after depositing the remaining CAD2500 or without depositing it?

Regards
You should replenish the funds and send a revised statement with an explanation as to why you used the funds and where you got them to replenish it.

Hi@ legalfalcon
This is my GCMS note analyst recommendation:- review required MI2 summary Note : officer please review client information.A11.2 : appears Met R87.1: CEC minimum requirements - appears Met outstanding Documents ( Not Requested ) :- RPRF ready to finalize RPRF : out standing
That’s it in analyst part in GCMS now what should I do ?? Thanks in advance
There is noting to be concerned about. When an analyst has doubts they will defer it to the officer, who will make a final determination.

Dear @legalfalcon

Since I am supposed to start business school next march, and my PPR is nowhere near sight, I applied for a study permit just to be safe.

For the study permit I uploaded my previous medical report that I used for the PR application this May.
The thing is, they have ask me to go get a new medical exam.

Is this normal? I thought medical tests lasted for a year.
Also, is this a good sign for the approval of the study permit? I don't think they would have me get the medical if they weren't ok with everything else.

Thank you very much

PR timeline:
AOR may 12 2017
R10 june 26
eligibility passed and security began july 27
no "security screening" mentions as of sep 26th gcms notes
The medicals for study permit and PR are different, as in their classification is different.

Hi @legalfalcon ,

I emailed CPC Ottawa about the Status of my application, I got this reply from them:

Your file is currently under review and requires additional verifications. As a result, the assessment period will be outside of our posted processing times.

Unfortunately at this time we are not able to determine when your application will be finalized, but our office will contact you as soon as all verifications are completed, or if any additional information or documents are required.
People who are in extra Security Screening usually get this if I understand correctly, however, my
Background check status on the website changed from "We are processing your background check...." to " Not applicable." a few days ago, signifying the end of my SS (supposedly).

Any idea or experience with this type of email reply? What does it signify?

Many thanks for your replies, we all appreciate your input :)

hi @legalfalcon
I am a study permit applicant from Pakistan. My application is stuck from 22 weeks. I enquired through a MP in canada and found out that I passed my eligibility in September and my application is currently on security checks since then I havent heard anything. The normal processing time is 3 weeks but tbh applications from pakistan take around 8-12 weeks on average. Is there anything I can do othere than waiting. I wasn’t issued any deferral request too (maybe because my acceptance letter had start dates for both fall and winter) I originally applied for fall and I am still waiting for a decision.
There is nothing much you can do, except to wait it out. You can order GCMS notes and see if there is another concern, which will be visible in the officer notes. However, SS for study permit is very rare.

I would not read much into the email as it is a standard email. Is your eligibility cleared? What does your GCMS notes say?

My notes say that R.10, Criminality, and Eligibiltiy are all cleared, I started SS in September 22nd. Only a few days ago has my BG check status changed to Not Applicable.

I did not provide the declaration from my spouse while submitting the application because I wasn't aware. I raised a CSE later with a declaration signed by my spouse that she is accompanying spouse in the application and funds in her account are to be used for Canada PR. It's not an Affidavit, just a signed declaration on a normal paper. Should it be fine? My current application status is NA2 and additional documents section Says "we do not require additional documents." request your further comments on this.

Hi @legalfalcon,

Need urgent advice on a personal situation. I'v been married for 4 years and recently me and wife have decided to part ways amicably. We've filed for a divorce via mutual consent and have first motion completed. I have got the court's interim order copy which states that divorce will be granted after completion of 6 months of statutory waiting period (will end in Feb 2018).

Got my ECA and IELTS sorted and presently have accumulated CRS of 456. While creating EE profile, I can see an drop down 'Separated' option listed under the marital status header.

- Can I proceed by choosing the above option (Court order proves that I am indeed separated) and enter the pool?

- If the divorce gets delayed in future due to any reason, will it create any complications during processing of my application like VO asking me to provide proof of divorce before granting PR?

Any guidance will be appreciated in this regards.
