The eligibility will remain the same until you submit your passport and a COPR is generated.

@legalfalcon Hi...could you please advise me on this
If your application is approved, the expiry of the document has no role. What matters is that you have to land before the expiry of your PR visa and COPR.

Respected Sir,
I am about to submit my NON-SDS visa application.

1) I have submitted a Physically signed Statement of Purpose (SOP) in the Client Information PDF.
2) Alternative is to submit a normal word to pdf SOP, so that it is easier for AI to read our SOP?
3) Or it doesn't matter at all whichever method you use to submit your SOP.

Nothing to worry. Once you have your Passport back, check your PR visa expiry date and it is that date before which you have to land.

There is no need to physically sign the SOP since you will be electronically signing the application. As long as your physically signed SoP is clear and legible, you can either upload the one in word (preferably pdf) or a physically signed one scanned in pdf format.

Its a visitor visa, now sure how your parent can help you settle. If you want them to visa, that is justified as long as you can meet the other parameters of a visitor's visa.

Hi @legalfalcon,

Propose of travel for mom to be like helping me to settle down in Canada means she ll be an emotional and mental support in early Canada days for me which can be hard. For instance, finalizing accommodation, buying home decor, looking for a job, etc.

So do you think this purpose of travel is strong enough? Or second option is she can tell that she just want to visit Canada with me for visiting beautiful places as a tourist. So do you think the former purpose is stronger or rather the later one? Thanks

Hi @legalfalcon,

When is the right time to apply for the Mandamus? I applied to EE PNP AOR 19 May 2021 (17 months). No progress since September 14, 2021, when biometrics and medical passed. Current status, security check-in progress, background not started, and eligibility in progress. I contacted the local MP and could not get any help. I requested a GSCM note back on 28 May 2022 and still got no answer. Are there any options for me to take the case to court and seek a Mandamus? Thanks!

A mandamus is a legal remedy and not a form that you can fill out and file. You should contact a lawyer (not a consultant), who can review your case and advise you on whether you have met the requisite time frame and whether your case meets the criteria for mandamus.

Hello,

I am out of status and I accidently missed to check the "Restore my status as a worker" option when applying for a work permit extension. Should I submit an updated imm5710 or letter of explanation through web form otherwise Should I withdraw and submit a new application?

@Singh101089 - Did you get your application approved? Please let me know what steps you did you take.

Thanks in advance.
@legalfalcon Please advise

@legalfalcon Hello Falcon,
I am very stressed about this.

I hold an OINP nomination that is tied to my employer. The employer was acquired by another company and the name of the company changed.

This acquisition happened a couple of months ago while my application with IRCC was in process. I still hold the same job title, duties, work location, NOC code, work hours but i did get a wage increase.

I only remembered to inform OINP of this change recently.( a couple of months after it happened). The day i remembered to notify them coincidentally happened to be the morning of the day which later in the afternoon I received CoPR on.

I have already informed OINP of this and waiting for their response. Do you think this will cause me big problems? What are your thoughts? What will OINP request?

Hi legalfalcon,
I just submitted CEC application with LMIA 50 points.
My closed work permit based on LMIA will expire in several months and the eligibility review might not pass before the expiration of my work permit.
The law 82.(2)(a) defines arranged employment as " is working for an employer specified on the work permit " when issuing pr visa..........

So I am really worrying that if I hold an open bridging work permit, vo might regard my "arranged employment" as ineligible and refure me.......Could you please share your experience and suggestion about this issue?

Thanks!

Hi @legalfalcon , could you help me out with this:

In the personal history section, there are two questions:
1. Has ___________ been refused refugee status, or an immigrant or permanent resident visa (including a Certificat de sélection du Québec (CSQ) or application to the Provincial nominee Program) or visitor or temporary resident visa, to Canada or any other country?
2. Has ___________ ever been refused a visa or permit, denied entry or ordered to leave Canada or any other country?

In 2020, I was stranded in the US with no flights back to my home country, so I applied for a transition to a B2 visitor visa to maintain legal status in the country. I then managed to catch a flight back before my original visa expired, so the transition visa was denied by default.

Question is, does this fall under question 1 or 2? To me it seems it can fall under either (i have bolded the relevant parts).

I have an official notice from US immigration, which uses the word "denied" with regard to my application. Here are the exact words:

"
You were admitted as F-1 nonimmigrant on ________. A review of Department of Homeland
Security (DHS) records reveals that you departed the United States on _______, while your
change of status request was pending. This departure from the United States constitutes abandonment
of your request for change of nonimmigrant status. Therefore, you are not eligible for the immigration
benefit being sought and your request to change status is denied. "
