Hi there

I am in quite the situation and am unsure on how to deal with this. Really looking for some needed advice. :)
I met my ex in July 2011. It was "love at first sight" for me. He told me his situation, that he entered the country as a refugee, but didn't think the courts would believe him and he would be deported in the end. It turned out he was lying, had made up some story that he paid someone to write for him. He talked me in to marrying him, he moved in to my house that I own. I paid for everything, even though he had a fulltime job. I bought him his car, paid for insurance and all the household bills. I paid for our wedding as well.
After our application was submitted in Dec 2011, he went from being the perfect husband to the biggest jerk in the world. He became verbally and mentally abusive to me and my young son (from another man). We stopped sleeping together 4 months before I told him to leave, we didn't talk or we yelled at each other. I had asked him to start paying me some money every month because I was going broke. He became extremely upset about this and would insult me. I have now sent notice to immigration that I would like to terminate the application, no longer wanting to sponsor this man. My ex has now threatened saying I "will pay for ruining" his life. I have spoken to a divorce lawyer but that didn't help much. I'm not sure what to do. I just want this to be over and have him out of my life. Has anyone gone through something like this? I believe that my ex used me since he just wants me to lie for him. After we separated, he kept telling me that nothing will happen to me if we just keep on lying. I couldn't keep going that way.

If he's already a PR, you can't terminate the sponsorship. You can always contact CIC and tell them you think he married you fraudulently and they might look into it, but that's all you can do.

So far I have sent an email to CIC Mississauga to withdraw my application from last Thursday but haven't heard anything yet. Our application had not completed processing yet, and I'm hoping I was able to cancel it in time. What happens after the application is canceled? My ex has threatened me with some kind of humanitarian/compassionate status, which will supposedly screw me over. Is this at all possible?

First, H&C PR is very hard to get and most applications are rejected.

Second, he can't use your relationship for H&C grounds if you're broken up.

If you applied in Dec 2011, your application is probably at the regional VO already. You should email that office. We can help you contact that office if you let us know which one it is.

He's pulling threats out of thin air to try to scare you and manipulate you into letting the application go through. If your lawyer hasn't done so already, file for a legal separation agreement and get a restraining order to keep him away from your house. If that car you bought him is in your name, list it as an item he must stay away from, then sell it. Have the police serve the order and escort him from the home. Yeah, it seems like overkill, but your safety is important.

Once you cancel your sponsorship, you're out of the picture. He'll deal with immigration on his own. I don't know what will happen to him in the long run, but at least he'll be out of your life.

Have you called the Call Centre yet? 1-888-242-2100. Since your application is inside Canada, they will have access to your file. They might not be able to give you specifics, but they can make notes on the file for the processing officer to see.

Sometimes it's hard to get through to the Call Centre. Just keep calling back. I've had to call 12 times before getting through before.

Vegreville's information on CIC's website doesn't list an email address. There may be one. I'll look at little more or someone else might know it.

I would get that separation agreement and restraining order done asap so he doesn't try to squat in your house, lock you out, or steal your belongings.

May I cancel my undertaking?

If you change your mind about sponsoring your spouse, common-law partner, conjugal partner or dependent children, you must inform CPC-M at CPCM-EXTCOM @ cic.gc.ca of your decision to withdraw your undertaking before the visa office issues permanent resident visas. You must clearly state your name, date of birth and Universal Client Identification (UCI) /Client ID number, if know, in all correspondences.

Once permanent resident visas are issued, the promise you and your co-signer, if applicable, made to support your family is valid for the term of your undertaking.

Just to add to this... when emailing CIC at CPCM-EXTCOM @ cic.gc.ca, make sure the subject line in your email says: Withdraw Sponsorship Application. This is specifically stated in the guide.

He can apply for humanitarian/compassionate relief, but it is unlikely he would win. In any case, once you withdraw sponsorship (as long as it is before he gets PR) whether he gets to stay in Canada or not does not need to affect you. If he is allowed to stay, you have withdrawn sponsorship so will not have to pay back the government for any welfare he gets. Most likely he will be sent home.
He can't officially screw you over. He might do something illegal, so getting a restraining order as others have suggested might be a good idea.
