Temporary worker re-entry

Hi everyone. My hubby presently works at Canada as a temporary working with a working permit. He's been there since April 2009 and plans to take an early Christmas vacation here with us at Philippines for 2010. But now, he's been having dilemmas on his plan. He said that one of his coworker was required by the immigration to renew his visa when he tried to re-enter Canada after his vacation. The immigration told him that his multiple entry visa is needed to be renewed since it will expire in less than six months. Is that true?

My husband showed me his visa and it will expire on March 3, 2011. This really saddened me since me and the kids are expecting him this December. We really need clarification and advices on this. Thank you so much.

Takes less than a month to renew the visa. Up to when is his WP valid? He can send the TRV app to Buffalo or Seattle.

Hi Job seeker. Thank you for taking time in answering my query. I mistakenly interchanged the dates. My husband's WP will expire on March 11, 2011 and April 6, 2011 for his visa. Question though, why would he still need to renew his visa if he will return in Canada before the date stated on his visa? Many thanks.

If his TRV is still valid when he comes back then he should not have any problem at the Canadian POE. Is the coworker also Filipino? Was the requirement to renew from the Philippines? He should have a letter from his employer though stating that he's just going for a vacation is going to come back and work for them again.

Hi job_seeker, thanks so much for your answers. Just as I thought, I really do think that there should be no problems since all of his documents are all valid and still within the time period when he comes back at Canada. Most of his coworkers have misconceptions about their multiple entry visas. Most of them got discouraged on having vacations outside Canada, worrying that they might not be allowed again to re-enter even if all their documents are all valid. I needed clarifications on these subjects to also relay to them these info to correct all what they thought are true. Regarding to his coworker, that still puzzles me. My husband told me that his mother died and needed to come back here suddenly. That person has a pending PR application at that time. If a temporary worker has an expired multiple entry visa and he is still at Canada, what happens to them?

With an expired TRV but valid WP, they can apply for the TRV either from their country of origin or they can send their application to the US, normally Buffalo or Seattle..

Thanks job_seeker for the information. Right now I think we may have a problem. He just told me that there is a note in his WP that he is not allowed for re-entry. What should we do? Thanks.

His TRV is still valid. Had it been that his WP is valid and the TRV expired then he can not be allowed in unless he got a new TRV. But the TRV with the WP that are still both valid will enable him to be allowed into the country. He needs a letter from his employer though (similar to an approved leave of absence), stating that he is going for a vacation for such period and will be back at such time.

The work permit, study permit alone will not allow re-entry. The visa must be valid and together with the work or study permit will allow the individual entry into the country.

hi! my husband is also on TRV and work permit that will expire November 30,2010. He went on vacation here in the Philippines last December 2009 and did not have any problems when he returned to Canada last January 12,2010.

just to advise you in case you did not know yet, before his return to Canada he needs to get and exit clearance from POEA, all OFW's are required to get this and will be checked at the airport before departure. Plus, it will exempt him from paying airport tax.
