Hi all, just joined the forum so hi.....

My background is this:
My wife was born & bred in Canada but lived in Ireland for 15 years. We have 2 Irish born children. We moved to Canada (Ontario) in September, me using a holiday visa
I/we are putting in our papers shortly - I have a criminal record, a fraud charge 8 years ago (3month suspended sentence) - will that affect my PR application?
Do I do the medical and get teh police clearance certificate now are during the process?
When, during the process can i start doing employment Ontario courses, apply for my OHIP, and most importantly, apply for a temporary work permit, or can i do that now, even before my forms have gone in?

Yeah.. This could cause you problems.

In order to overcome your criminal inadmissability, you may need to apply for rehabilitation. This is what you need to fill out:

cic.gc.ca/english/information/applications/rehabil.asp

If the application is successful, and it likely will be, because 5 years have passed since your conviction, then you may apply for permanent residence, with your wife sponsoring you.

Your children are eligible for canadian citizenship through descent, you will want to apply for this right away.

As to how long it will take, it could take anywhere from 6-9 months upwards to receive first stage approval, or longer if they have any problems with your application. I advise you to apply in the outland stream, as it can be quicker, and you have the right to appeal if you are turned down for any reason.

Do your medical, and do the police clearance now and send them in with your application. Not sure if you will need medicals for your kids as they should have derived canadian citizenship, but you may need to to satisfy your application.

You may apply for an open work permit and send it in with your application, the applications are back-logged so they will not look at your work permit application until they are ready to process your permanent residence application. If they process your PR application and everything goes well they will give you what is called 'Approval-in-principle" and if you submitted your work permit application along with the PR application then they will process that as well.

With your open work permit being approved, and approval in principle for permanent residence, you will still have to wait 3 months after landing to get your health card, however you may be able to apply for a social insurance number and start working right away.

Remember even though you have two kids together, to send in lots of proof of your relationship, photos, records of your mingled finances, everything you can get basically to prove you are a 'genuine' couple. Definitely look over this forum and try and educate yourself as much as you can, and if you have more questions feel free to ask them, before you send in your forms. Make those forms perfect so there will be no question of turning you down.
