Temporary Resident Visa before Study Permit

Hi All,

My brother in law is willing to pursue higher education in Canada. My spouse and I will be moving before he could relocate next year. I wanted to check if it's possible for him to apply for temporary resident visa and come to Canada to stay with us. If yes, what is the process? As and when he get acceptance from any institute, he can apply for Study permit.

Please help!

He can apply for a TRV and if the TRV is approved, apply for a study permit while in Canada - however his application will have to either be sent to his home country's visa offic or to a US visa office for processing.

It would be much better to apply for a study permit while he is in his home country than in Canada as a visitor. To be approved for a study permit, you must show that you have strong ties to your home country and have no plans on remaining in Canada long term. For this reason the chances of approval are higher if he applies while he is in his home country.

Hi Scylla,

Very clear. But we do have a long term plan for my brother in law - to study and work in Canada.

So, while applying for the study permit from India (home country), will the condition you mentioned be a constraint in supporting our case?

Moreover, looking at the options, I feel first one should work for us provided its not complex and time consuming.We are considering it to be best way if we can take him along while we are there.

Again, to be approved for either the TRV or study permit, he will need to prove that he has strong ties to his home country and has no plans on remaining in Canada long term. If CIC suspects he has plans to remain in Canada, it's quite likely the visa will be denied. So he needs to focus on providing proof that shows home country ties (not his future plans in Canada).
