An interesting question has come up. If a person is working in Canada on a temporary permit and desires to join a netowrk marketing company while working under this temporary permit, is he allowed to do so. He is self employed as a network marketer and the company is open for business in Canada as well as in his country of origin. People in Canada can enroll anybody online from any of the companies in which the company does business, although they have no right to work in those countries. People in his country of origin have the right to enroll people in Canada online although they have no right to work there. So can this person enrol while in Canada and work at his business without risking his temporary permit? Would it make a difference if he enrolled in the network marketing in his country of origin. The company is not Canadian but does have a Canadian office and presence. Thoughts and suggestions are appreciated. Thanks

1. IMHO Company has a presence in Canada, probably considered working without permission. Also even if he enrolled in the overseas company, he couldn't enroll Canadians, while he was in Canada.

can anypne direct me to the court case that is referenced in the following post? When there are literally hundreds of thousands of people worldwide doing network marketing online, none of whom are employees of any company, it seems very restrictive to say that a person is prohibited to do what those other hundreds of thousands of people do because he has a temporary work permit. His brorher in any other country in the world can sign people in Canada into network marketing online, but he can't do so? This certainly is not taking any work away from Canadians. In fact, it may be doing just the opposite. I would love to read the court case, so if anybody knows what it is, please let me know. Thanks.

In theory, any work that you conduct in Canada is subject to the requirement of an employment authorization. There has, however, been a recent court ruling that stated that such an authorization may not be required in a case in which no Canadian employer exists, but where the work is conducted which within Canada.

If you start and work for a business that is not within Canada, you would not generally be considered to require an employment authorization.
