Hi,
Guys please help..

I am temporary worker and intra company transferee with closed work permit and have been told that I have to stop working from nxt week as my company has sold the Canadian business. My TRV and work permit is valid till December2016. I have my family with me and my wife has open work permit and TRV valid till dec. 2016.

My questions are,
1. Can I stay in Canada?
2. Can I apply for new job or find a new employer?
3. I have applied for PNP under the skilled worker category, what will happened to my application?
4. If I am losing the job, what will the status of my wife open work permit?
5. If new employer willing to offer me a job, we have to go through the process of obtaining new work permit?
6. What is LMIA, will it take long to obtain the LMIA, who dose the process for LMIA, is it employee or employer

1. Yes - you can stay in Canada.
2. Yes - you can look for a new employer. However to work for a new employer you will need a new LMIA and new work permit.
3. It depends whether your application is supported by your employer or not. It could.
4. She can continue working as long as her open work permit is valid.
5. Yes - you have to go through the full process including obtaining a new LMIA and a new work permit.
6. The employer must obtain the LMIA. This process can often take 4-6 months to complete.

Hi

I am also a contract worker and my TVR and work permit expires on June 2016 and I really wanted to stay here for good. Since we all know that in order to stay here I have to Apply for permanent resident. My problem is that I am not sure if my employer is going to offer me a job to extend.

My questions,

1. Is there any possibility that I can apply for express entry under Canadian Experience Class?
2. Do I have to get LMIA to apply for express entry?
3. Are my work experience back in my country is counted under the Express Entry?
4. If I have a prospect employer already can I include them from my application?
5. What agency can I visit for any advice that could help me?

Thank you

hi, Scylla..

Thank you for reply. I appreciate your point wise reply to my questions. I have one more question as I may have to stop working soon because of my closed work permit and my company back home is offering me a job back home but I want to stay in Canada for better good of my family. My question is,

In this situation, Can I claim my Employment Insurance?

How long have you been working in Canada?

1. Only if you have worked in Canada for at least one year full time in an occupation that is skill level A, B or 0.
2. No.
3. Yes.
4. Only if that employer has obtained an approved LMIA for your role.
5. None that I know of. You would have to hire an immigration consultant or lawyer to assist you. Expect to pay between $3K and $5K for reputable advice. Don't expect the lawyer/consultant to be able to secure a job offer for you in Canada. This is something you should expect you will have to do on your own.

Hi Scylla,

Thank you!

I have been working in Canada since last 10 months as full time worker (As Manager). My skills are specific, I am an electrical engineer with 10 years plus experience in High voltage/power transformer field.

You may get Employment Insurance. Seems like some people with closed work permits have been denied EI but I am currently receiving it.

I did get a phone call with a lady with Service Canada that brought up my closed work permit and questioned me about how I can find work with a closed work permit. I was very confident and told her that there is a lot of hiring done in my field and I can easily obtain a new work permit. She approved my application. Seems like it's approved on a case-by-case basis but absolutely apply for it.
