We got married in early part of 2010. We have 1 child together. When he filed for 2009 taxes (as single since he was not married in 2009), he ended up oweing like $800.00 since his work place did not withhold enough..so for 2010 he asked them to withhold more to be sure he will not owe any in the future.

Ok here is my question...

Now that we are married and I landed in December 23, 2010..(PR was issued in Oct) and I have my SIN#, if we filed as a married couple with a child, would he be able to claim us and get taxed less?? therefore he might get some refund? I am not familiar with Canadian taxes so I would like to know if there is something coming back to us lol. :p I know in the states there is more benefit to file married/joint with dependent. I am hoping it is true in Canada as well.

Btw I am a stay at home mom.

Yup, I would think that you both should get some kind of tax refund especially if you have a child (dependent). It will be applied to any taxes owing of course. Best thing to do is to proceed with the filing and see what the outcome is. Be sure to apply for your GST/HST credit, and your child tax credit too (if you haven't already).

Could you please tell in what province you landed ? The taxes are different with provinces.
I think as you landed in Dec 23, then 7days can only be taken in account = prorated. It is about 2% of year 2010.
The same could be the tax advantage, 2% - not more.

I am in Ontario. I have no idea about how it works in provinces or federal. I am hoping someone can tell me how it works. I was thinking like when having a baby..no matter when they are born in that year it counts..lol so I assumed that as long as I landed (and had a SIN#) I could file with my husband without getting prorated.
