Suspending Application for PR

Hi all,

This just in - we got a letter on the weekend saying that my application to sponsor my husband has been approved. Great news. HOwever, we are also having doubts about moving across the world at this time, with no jobs and no house, with the economic climate being what it is. I have a very secure job here in the UK that is asking me to stay, etc. But one factor in our decision has to be - what happens to his application for PR??

a) Can we suspend and re-activate it in a year or so?

b) Should we let it carry on, hopefully be granted, do the bit where he enters the country to confirm it, but not move to Canada until we feel more secure (6 months to a year)? How long can we live outside of Canada before compromising his PR?

I would email the consulate in London to ask this, but will never, EVER hear back!

Keep the application rolling. By the time he actually gets his PR, you might be ready to move. If not, he can keep his PR outside of Canada for up to 3 out of any 5 years BUT accompanying a Canadian citizen spouse, he can keep it forever.

Are there any guidelines as to what the Canadian Citizen sponsoring spouse (my wife in this case) is doing while living outside Canada. i.e. do they need to be on a Canadian compnay transfer, or something like that, or could they be holding any job of thier desire, while I maintain my PR status while staying outside Canada with her?

Leon can you clarify this for me. Could someone get approved for Outland Sponsorship, go to Canada with spouse for perhaps 6 months to 1 year, attain PR, then go back to Sponsored person's home country and they would retain their PR, simply because they are accompanying their Canadian spouse?

The Canadian citizen spouse can be doing whatever, sitting on couch eating bon-bons all day for all they care, just as long as you are with your Canadian citizen spouse, your PR is safe. Canadian company transfer is only needed for PR's who are not married to citizens.

There is no requirement to live in Canada after getting PR, not even for 6 months. Someone could get approved for Outland sponsorship, spouse can go alone to Canada to "land" as PR or they can go together. Stay 1 day or long enough for nice vacation, then return and stay PR as long as they are together.

Thanks so much for your help, Leon.  I think you are right.  We'll let it roll, stay on at our jobs here until we hear whether PR is granted or not.  So imagine it is granted in April - does my husband have to make a trip to Canada to validate the PR?

Imagine that they asked for medicals in January 2009 and he did them and got the visa in April, they usually go a year from medicals so he would have until January 2010 to "land" in Canada but it will say on the visa when he gets it how long it's valid.
