Hi all,
After a long wait finally got a refusal letter in the inbox with reason stating

“• I am not satisfied that you will leave Canada at the end of your stay as required by paragraph 179(b) of the IRPR (https://laws-lois.justice.gc.ca/eng/regulations/SOR-2002-227/ section-179.html). I am refusing your application because you have not established that you will leave Canada, based on the following factors:
• Your proposed length of stay in Canada is inconsistent with a temporary stay given the details you have provided in your application.
• You have significant family ties in Canada.
• You do not have significant family ties outside Canada.
• The purpose of your visit to Canada is not consistent with a temporary stay given the details you have provided in your application.”

In the visit details, i had put a total time of about 9 months stay and put some items such as sightseeing, going to national park etc and put some dates there coinciding with long weekends. What is so inconsistent about that? what do these cic employees want to see in the application?

Now i am thinking about applying for a general visit visa that grants 3 months stay. If you have any experience or tips, please share. Thanks for reading

In the Invitation letter how did you prove significant ties of your mother with home country? I am in the process of applying for my parents

What is significant ties? She lives alone and she doesnt need to work. Maybe thats why they refused it.

Does she own a property? If yes, thats economic tie. Does she get some pension? Thats again a tie. Does she have brother / sisters in India? Thats tie.

Also, make the purpose of visit as "Want to spend time with my son in canada". She is not coming here as a tourist and super visa is not a tourist visa but more of a family reunion thing.

Do you have a young son or daughter? Show how important it is for them to spend time with their grandparents. Its again one thing that Canadian government promotes and partly rooted in Canadian Values so IRCC nerds do not reject easily. Also show how due to covid you and your family (son/daughter/spouse) were forced to not being able to meet from your mom.

Ties is to show she has something back home that is greater than her overstaying in Canada beyond the rules of the visa.

I am not sure if you applied using the new portal or GC Key. The new portal had a lot of TRV processing using Chinook & my family was a victim of wrongful refusals which I did a judicial review on and their refusals was cancelled and Visa issued. There were no Additional Docs requested as I had submitted everything in my application.

If you think you have declared everything and this may be a wrongful refusal, invoke Rule 9 and do a JR on this.

Good Luck.

What family ties she gave in Canada and what family does she have inNepal? If you have siblings? Where do they live? I would suggest asking for at least over a 1 year stay if applying for a supervisa. There is no need for a detailed itinerary. Does she have her own savings or are you supporting her in Nepal? Does she own property? Is she a widow and got how long? Has she travelled internationally before? To where?
