I stumbled on this very informative forum while preparing a Supervisa application for my father and want to start off by thanking everyone on here for their invaluable input which I am sure has tremendously helped people like me.
My father and I have decided to apply for a Supervisa for him to visit me after his recent visitor visa was refused and we are trying to address the reasons for refusal as much as possible in the supervisa application to increase the chances of it being approved. I have been incorporating some tips provided on this forum for my invitation letter. I would really appreciate some input on how we plan to address them and some other factors in our situation that I think might influence his case.
The letter of refusal for visitor visa basically stated that the officer is not satisfied my father will leave Canada at the end of his stay, citing the following reasons (my comments/explanation in brackets):
- Family ties in Canada and country of residence
(Myself (Canadian citizen) and my brother (PR) live in Canada - my father's only children. My mother (Citizen) also lives in Canada but she and my father are divorced and estranged and he does not plan to visit her during his stay. My father's sister, nephews, and his extended family live in India and he is very close to them. Can this situation count as his ties being stronger in Canada than in his home country?)
- Length of proposed stay
(We had indicated 5 months on TRV given that the maximum is 6 months, and I believe for a supervisa it "can be upto 2 years". From reading other posts here I realize that this may be judged on the "CAD 1000 per week available funds" criteria. Could this be indicating to the VO that he does not want to leave Canada based on a long period of visit?)
- Purpose of visit
(Basically to visit me and my brother, but I figure we should elaborate more for a visit planned to be a few months long?)
- Personal assets and financial status
(My father can show approx $10000 available plus property owned by him but he is retired and a pensioner. Does this also tie in to the length of stay on the basis of $1000 per week, that the duration and funds probably don't match up? My income is above LICO)
-Travel history
(The only factor I can think of here is that my father used to have PR sponsored by my mother when they were married and it expired 3 years ago without him meeting residency requirements. And he has now renounced it without appealing for renewal. Other than that he has never been refused visa until recently and always met the regulations during previous visits on PR, which were 2-3 visits a couple of months each. I wonder if this can be seen as an intention to stay in Canada, but then again, he did not wish to move here permanently in spite of the PR so that should demonstrate his intentions to return?)
I also plan to include that I have limited vacation allowance from my job and if I were to visit him it's quite far and would be a relatively short visit. It's more convenient for him to visit, so he can visit my brother as well (who has to have weekly medical appointments with his doctor here, and cannot afford a trip financially either). Not to mention, my father is very traditional and simply does not want to leave his home country permanently to live in a faraway unfamiliar country, regardless of family ties here. So I plan to mention that in my letter for what it's worth.
If anyone has any input on whether this makes a favourable case for an application, I would really appreciate your opinion and suggestions.
