Well here's an update... After hearing nothing after submitting more documentation back in December, and applying for a visitors extension we received an email from the London Office on Jan 15, 2010 advising his Visa was ready for issuance!!

We mailed his pp/ photos and further paperwork on Jan 16, 2010. His visitor's visa extension came in in the interim on Feb 19,2010 granting him a stay until December 21, 2010.

Finally we received his pp/visa and PR paperwork on March 1, 2010 but the visa was only good until March 3rd!!! So due to the fact the Halifax Immigration office was only booking appts 3 weeks in advance we had to go to the closest US/Canada border to what is called a " Flag pole procedure". Over 15 driving hours later we made it to Calais Maine, did the flagpole and came back in to Canada .

He is now officially landed as of March 2,2010.

Both the US and Canadian Border Patrol Officers were extremely nice. And I have to say that once I actually got through the Immigration Canada information line to a real person they were extremely helpful and even called back to our home to advise of the closest Border to us with the operating hours.


One journey is complete the other just beginnng. Thanks to those who gave kind words of encouragment. And best of luck and faith to those still in the long frustrating wait.

Congratulations Longshanks! I know now that conjugal applications can be success on that basis if everything else in the process in not complicated. We'd applied as conjugal and, while the application was ultimately rejected, CAIPS notes (except I ordered the whole file) Case Status Selection said the following:

Subj and sponsor began corresponding .... they continued to correspond and had fallen in love. They have no plans to marry at the moment. Sponsor has been married and divorced. Subj is a widower. Based on info and documents on file, I am satisfied that this is a bona fide relationship. Interview waived. Passed selection.

So there are cases where, conjugal apps will be approved even if there is nothing barring a marriage. That said, we a looking forward to our wedding next week

Congratulations, Longshanks and thanks for the email letting me know you application was approved. I tried to reply back but your inbox is full.

I hope that other US-CAN heterosexual conjugal partners will find our stories and will not be discouraged by posters here that say it's a longshot at best. We are both examples that it can be done! Please consider sticking around the forum and giving encouragement (private or public) to others who've applied as conjugal partners. If someone had written a note to me as I did for you, I would have felt a lot better about the whole process!

May you have many happy and relaxing days ahead now that the wait and worry is OVER!

Thanks for your note. Here is my case. Would appreciate all your thoughts/ideas.

I am married but separated for the last 3 years. I am a Pakistani citizen but also a permanent resident of Canada. Now, I am into a very serious relationship with a girl in Pakistan. Being a Pakistani citizen, I relocated temporarily to Pak to be with my partner as it would be difficult for her to have a lengthy stay in Canada through a visitor visa.

I also filed for my divorce in Pak and have had no co-operation from my separated wife for the process. The process is time-consuming and I do not have a clear picture of the time frame that would be needed to get divorced.

My partner and I are both committed and depend on each other for a living. We live together in a live-in relationship. We have a child 5 months old. However in Pak (unlike Canada) it is a CRIME to start a common-law (live-in) relationship with someone while legally married (though separated). So, we are continuously worried about the implications of our life together. So, for us to start our life together as common-law partners without any problem, we need to be in Canada as Canada considers one to be legally separated AS SOON as 1-year separation is completed and also it is NOT a crime in Canada to be a common-law partner with someone who is separated but still married.

Given that my marriage is broken down (3 years separation) and given that I cannot marry/have a live-in relationship with my partner in Pak until I get divorced, the only way for us to lead life together peacefully is in Canada.

Will I be eligible to sponsor my partner under the common-law partner class once I relocate to Canada (not sure whether I need to live with my partner while applying)? Will they accept our relationship as a common law relationship though we lived together only in Pak and not in Canada? Or should I try the conjugal partner class?

Please enlighten me.

Conjugal partnership

sorry I'm new here and I don't know how to make my own thread. I have a question sir/ mam, my girlfriend is still married but the annulment case here in the Philippines is already filed. She and her husband are both okay with the annulment. She's an immigrant in Canada and would like to sponsor me from the Philippines so I can be with her at the time she gives birth to our child. We've known each other for almost two years now and she's pregnant with our 1st for more than 3 months now. We are running out of options and already panicking because her due date is September 2012. I hope the Canadian Immigration allows me to stay or be with her forever if not allowed I am willing to com back home to the Philippines and bring our child here until we are allowed to go back with our complete requirements for PR.

can anyone help me please?
