Submitting a dual intent visa application - working permit and FSW visa apps

Hi all

Yet another question regarding switching from a working holiday visa to a FSW visa.

I am currently living in Canada on a working holiday visa and have 3 months left on it. My employer has offered me a permanent position and is currently applying for an LMO.

I'll need to apply for a temporary work permit to bridge the gap in between my working holiday visa expiring and my FSW visa application being accepted and issued.

I read on canadavisa dot com that I can apply for both my work permit and my FSW visa at the same time with "dual intent"

"Dual Intent refers to the concurrent processing of an application for Permanent Residence and an application for Temporary Status, therefore demonstrating the intention to both reside in Canada permanently and only temporarily, at the same time."


Does anyone know how I would go about submitting the applications? Do I submit the work permit application online first and then the FSW application in the post? Can I submit them both together in the post?

Also, can I even apply for my work permit online if I am already in Canada on a working holiday visa or do I need to submit an application in the mail?

No, they are submitted to two different locations. The work permit may be submitted to Vegreville, either on paper or online. It takes about 60 days for them to process your work permit renewal last I looked. If you are near a border crossing with immigration services (http://cbsa-asfc.gc.ca/contact/listing/indexpages/indextype38-e.html) you can process the request by going to the border and turning around ("flag poling") and they can issue it on the spot.

The PR application must be sent to the appropriate processing centre (Sydney, I assume in your case).

The order doesn't matter, but keep in mind that some applications do ask you about other applications you have submitted.

Thanks so much for your reply, computergeek. I didn't realise that I could apply for my temporary work permit at the border.

I hope you would see this message before proceeding with taking an action.

My advise is that try as much as possible to submit the work permit application and wait till its concluded before proceeding with a PR application. Do not rely on the seemingly magnanimous dual intent rule, it is not that way in reality. If u applied for a work permit while a PR application is pending, u are not likely to get it. It has happened to me before. A work permit is under temporary visa category.

They will likely give you baseless reasons like "your purpose of travel, your travel history bla bla" as the reason for refusal when your purpose of travel is the reason why you applied in the 1st place. I knew very well that I did not get it due to my pending PR application because earlier in an email inquiry that I made to know the status of my study visa application, they gave a reply that a decision has been made and that my FSW application is pending. Then I suspected immediately that something was wrong because I did not expect them to give me an update on FSW when I only forwarded an inquiry on my study visa application. We were 3 that applied at the same time from the same visa office, the 2 other got their study permit and I did not. I helped the 2 other ladies through on what document they should submit and how. So I am very convinced that the DUAL INTENT thing was actually what got me into trouble.

U can give it a try if u wish but I am only giving you my experience, 1st hand.

My experience is the opposite. I had an FSW application in process when I applied for my work permit and had no problems obtaining it. If you have the flexibility to submit the work permit application first, by all means do it - there's nothing to be lost by proceeding cautiously.

Hi

You seem to have a good knowledge of the visa and PR process. I have work offer and I fulfill the criterion of FSW. I was thinking of applying like other guy (dual intent Work permit + FSW simultaneously) and after seeing yours....kinda stopped.

Once you get work permit.....how to proceed for PR?
Submit for FSW before landing in Canada. or Go there and apply from Canada itself?

Please if possible let me know how to proceed.
