HI me and my wife live here in Canada since 2013 with work permit will expire on 2018.
My wife studied her in Ontario and she was awarded with the new changes her score is 475 now, but if she switch her profile to single she will get more point than with spouse (me).
Is possible that she can switch her profile from married to single, or not consider me ir order to get a better mark points, and once she get the PR apply for a sponsorship to me (her husband) I will be here in Canada by that time I think, or maybe if the proccess takes time, I can apply for a BOWP before my WP expires on 2018? thanks

Others will probably correct me but I think that might be considered misrepresentation implying she is single plus anyway immigration I assume already are aware she is married to you through any current permit. Why would you take any risks at all ?

My Recommendation would be to apply together since you have one more year on WP and 475 is good score to get ITA within next few months.

If you still want to apply as single what you can do is show marital status as married but answer to question for accompanying spouse, that way you are not she will get more points and also you don't have to risk misrepresentation.

I would suggest keeping you as an accompanying spouse (dependent) in the application. She will get her ITA with 475 eventually.

Technically you can do what you're asking and although I do not agree with it, it is common for people to do that. As of now we haven't heard of consequences for such actions.

Cheers :)

consequences for doing non accompanying spouse is you probably have to leave the country if your WP expires, also Sponsorship takes about a year or more so it's time consuming.

You can't apply for BOWP unless you have active PR application in progress.

It might be incorrect, depends how IRCC see it. The OP plan to remain in Canada and even apply for BOWP, so choosing "non accompanying " spouse while the spouse in fact "accompanying" might be seen as misrepresentation.

It only becomes misrepresentation if they apply for BOWP or Visitor visa to extend the stay for non accompanying spouse, which I just stated earlier saying that he can't apply for BOWP. The current WP he has nothing to with express entry profile or PR application, and if he is willing to go back to his country once his WP expires wait there till his wife gets PR and sponsor him, I guess that's not misrepresentation.

that is not right approach, even if u get ITA, u will hard time to justify why u r not including ur spouse. U have 475 points and ur permit is up to 2018. It is matter of few months and u will get ITa. Relax.

Too much risk, your points are good, stay together.
