Studying in Canada

hey guys, I have a question hopefully you guys can help me out with. I went to the united states as a child and did all of my studies over there. Unfortunately my family and I were deported when I turned 20. Now Ive been married for 4 years to an american and Im being sponsored by her mother to go study in Canada. Will the fact that I got deported due to overstay prevent me from getting the visa? even though I was taken to the United states at the age of 7.

Yes - there's certainly a chance the US deportation will impact your ability to get an approved study permit to Canada. Make sure you mention the deportation on your study permit application to Canada (Canada will find out about it even if you don't mention it) and use this as an opportunity to try to explain the situation favourably (e.g. you were brought to the US as a child by your parents).

You will need to show very strong ties to your home country to be approved given the deportation and the fact you have an American spouse.

If you have been living in your home country for several years now, that will certainly work in your favour.

Thank You so much for your time, Yes I have been living here for 4 years but my wife goes back and forth. I also had very good grades graduating top 10% of my class and having 3 full rides to 3 different universities but i was unable to take advantage of it because of my status.I've tried going to college here but the fact that I can barely read or write spanish makes it really difficult .Will that help me at all?

This part won't help you at all. The main thing you need to prove to be approved for a study permit is that you are a genuine student, that you have strong ties to your home country, and that you have no plans on remaining in Canada long term (i.e. you plan to return to your home country once your studies in Canada are complete).

Thank You again, and ok last question, if Im able to prove I have ties to my country do you think I even have a shot at getting the Visa or am I just wasting my time and money?

It's really hard for me to say. I think if you can prove very strong ties (e.g. property owned, job offer when you get back, business in your home country, etc.) then you may have a small a chance of being approved. I think the fact your mother-in-law will be funding your studies will work against you. It would be better if you were funding on your own.

Again, very difficult to say what your chances are. The deportation certainly lowers your chances.

I have a really quick question, My main thing is I want to study in canada for 6 years to get my civil engineering degree and If God permits do it in University of Toronto . I am not allowed to go back to the states for 10 years. However almost 5 years have already passed by and my spouse visa has already been approved for the states. That being said clearly my plans after college is going back to the states where my main ties are and not waste time in the mean while. Would this be in my favor?

No - this won't play in your favour. It will actually probably work against you. Again, what CIC wants to see is strong ties to your home country and proof you have plans to return to your home country.

You currently have no status in the US and additionally have the 10 year ban as a result of your overstay of greater than 365 days. The fact you have plans to move to the US once you are finished your schooling in Canada demonstrates weak ties to your home country and could suggest that you aren't really a genuine student and are just using Canada as a place to park yourself until you can get back into the US.
