Someone please help me
So I am international student. Got suspended almost half a year.they have asked me to leave Canada as I can’t study anymore.but I have my study permit till 2024. Why does this happen? I was planning to go back to my studies in January but they say my study permit is not valid ?
so question is
Is my study permit still valid ?
what should I do now?
can I reapply study permit within Canada?

IRCC cancels your study permit if you stop attending school. It sounds like this is what has happened to you.

This means you need to apply for a new study permit.

If your study permit has been canceled, that means you're now in Canada without status. You would need to start by restoring your status to visitor, as long as you have been in Canada without status for less than 90 days (restoration is only possible within 90 days of losing your status).

The study permit application cannot be processed within Canada. You will need to apply through a visa office outside of Canada. To be very honest, I don't think there's any chance you're going to get a study permit approved for January if you apply now. There isn't enough time remaining.

My advice would be to return to your home country as soon as you can, defer your studies to either the spring or fall semester of next year, and then reapply for a new study permit from your home country. This is almost certainly your best option.

Your study permit is not valid any more since you stopped studying for almost half a year.

Who are they that's asking you to leave? What document/email/notice did you receive?
If it's immigration, you really should leave Canada soon.

You can apply for a new study permit. I hope you did not overstay.

My daughter applied for a graduation program in a university and they said since we are not consider as a refugees, my daughter will be consider as a international student and should submit study permit. She has studied in Canada since 2017.
Kindly let me know how to resolve this issue as she lost her valuable study time and we are all under stress

This is a bit of a complex scenario. I agree that her status is not refugee. Effectively she has no status in Canada right now pending the processing of the H&C application.

There are only certain circumstances where someone can submit a study permit from within Canada. These circumstances are below. I think the only one that may match your situation is the bolded one. Do you have an unenforceable removal order?
  • you have a valid study or work permit
  • your spouse, common-law partner or parent has a valid study or work permit
  • you’re a minor child in primary or secondary school
  • you’re an exchange student or visiting student
  • you completed a short-term course or study program required to be accepted at a DLI
  • you or your spouse, common-law partner or dependent child has a temporary resident permit (TRP) valid for 6 months or more
  • you’re being sponsored to immigrate and you already applied for permanent residence (if you’re eligible)
  • you or your spouse, common-law partner or dependent child are subject to an unenforceable removal order
  • you’re the spouse, common-law partner or dependent child of:
    • an athlete on a team based in Canada
    • a member of the media
    • a member of the clergy
    • military personnel on duty in Canada or
    • an accredited foreign representative
  • you’re a refugee claimant in Canada or a family member of a refugee claimant in Canada

In that case it doesn't sound like your daughter meet any of the conditions to apply for a study permit from within Canada.

The application would need to be submitted to a visa office outside of Canada. However I'm not sure that IRCC will approve an application where someone is out of status in Canada. I don't know what your next steps would be or if a study permit is even possible right now. Maybe it will be possible after AIP? Hopefully others will comment.
