Study permit violation

I've been in Canada for around 3 and a half years now doing my undergrad. So far i've been a full-time student for all semesters, however, last year during my fall semester, I had to drop 2 of my courses since I realized that if I didn't drop them i'd end up failing them. I found out recently that dropping those 2 courses made me a part time student. Unfortunately, that's also the semester when I first started working part time (20 hours per week).

I plan on applying for a post-graduation work permit once I'm done but I was wondering how severe of an impact this study permit violation would be as you're not allowed to work part time while you're a part time student. I'm afraid to call any official Canadian immigration services agent to explain this situation as I'm worried that they may put a mark on my file leading to consequences.

Unfortunately it's impossible for any of us to say. It will be up to the officer who processes your post graduate work permit. Note that you actually have two violations. One is the illegal work. The second is studying as a part time student. To qualify for a PGWP, your studies must be continuous and full time. You can be part time, but only in your last semester.

Again, impossible to say if you will run into issues with the PGWP or not - you'll just have to apply and see what happens.

Hi watercomplex1!

Any updates regarding your violations and PGWP? I actually have the same situation. Although mine was 3 semesters part time student and have been working part time at the same time :( I finish school in May 2020

Unfortunately I don't think you have any chance of getting an approved PGWP. You would need to start a new program from scratch and make sure you maintain full time studies throughout this new program. You could then qualify for a PGWP that's the duration of the length of your second program.

It's probably unlikely that will happen. Although working for three semesters while a part time student is pretty bad.

Most likely, you'll finish your studies, your PGWP will be refused, and then you'll have to return home. So biggest impact is most likely to any future plans to apply for PR.

You weren't entitled to work at all. You must be a full time student to work off campus. The fact you worked more than 20 hours makes it that much worse.

I honestly wouldn't even bother applying for a PGWP. It will be a waste of time and money. Between the number of part time semesters and the work violations - there's no chance of approval.

What if they found out working under the table?
