Study permit refused ! Need urgent help.

Dear All

My study permit was refused on September 10th for the following reasons
• I am not satisfied that you will leave Canada at the end of your stay, as stipulated in
subsection 216(1) of the IRPR, based on the purpose of your visit.
• Your proposed studies are not reasonable in light of: your qualifications, previous
studies, mark sheets, academic record, and level of establishment, your future prospects and
plans and/or language abilities.

My profile is as follows

B tech Automobile Engineering completed on 2012 (63%)
Worked in the General Insurance Industry for 8 years as Service Engineer for motor insurance claims.
I have the offer letter from Cambrian College for supply chain management (1 year ) and paid the first semester fee also.
Proof of funds : 1st semester fee, 1000 CAD GIC, 8800 CAD in my parents account as my next semester fee.
Application timeline:
Non SDS, applied on July 23rd
Visa refused on September 10th.
Reapplied on September 28th with a stronger SOP and its decision is still pending.
Biometrics scheduled for December 24th.
I had requested the GCMS notes earlier and it was received today.
Both refusal letter and GCMS attached with this thread.
Is there anything i can do to get my visa approved ?

Your file was refused outright by the Case Processing Officer ( CPO ) , however this is still an unreasonable standard of review from their side. They should had at least read the SOP. It's pretty much straightforward, you need to change your course more aligned with your background and show ties.

There is an issue with funds as well. What other funds have you shown?

The issue remains that this is a lot of money and why would you need to go abroad to take this course. The fact that your marks were not that strong is also an issue. A 1 year course ill only give you a 1 year WP which makes it hard to get a 1 year of skilled work to qualify for CEC. What were your IELTS scores?

S1 does not promote field changes, even students from prestigious universities like Waterloo get refused despite choosing Masters but in a different field. The diploma path works only for young applicants, candidates over 30 are suggested to only go for Masters. These are fixable, apply again addressing the issues, these are common refusal reasons and nothing major.

I have 88 % for 10th and 12th. This is the only fund i have shown.
My IELTS score is
L=8.0,
R=7.5,
W=6.5,
S=6.0,
OverAll=7.0

The visa officer determined that you're not a genuine student who intend to comply with immigration regulations. If you're not complying, then your permit will be refused again.

Below is my understanding:

1. Your SOP should explain in detail about the flags (whatever you consider needs explanation) in your application. Ex: Change of course, plan for future, etc

2. You need to show funds for 1st year of tuition plus living expenses, I advise showing atleast 1.5 times the total funds required and the past ITR etc should show enough income to cover future costs and also if this is not covering the costs, loan documents or other proof of funds (someone sponsoring you), I believe, would convince the Visa Officer of your capability to pay your expenses in Canada.

3. Looking at the GCMS notes, they want you to either prove that why Canada for the career option and either of the following:

i) You have dual intent and plan on staying in Canada, then prove what you'll do with your education and provide value
ii) You plan on coming back to India and thus show how your education in Canada will help you make your roots in India stronger.

Visa officers understand the cases based on the application and the clearer the application, better their understanding.

I was applied for my PhD study permit from Ethiopia on November 27,2020 after i received my CAQ , but was refused on December 15,2020 . reasons for refusal as stated by VO
1- I'm not satisfied you leave Canada after completion of study based on your travel history, family tie, personal assets and financial status.

I felt heartbroken and don't even know what to do next. Please forward me your comments.

You are using a temporary study permit to stay in Canada without intention of leaving at the end of your studies. This is not allowed and therefore you will be refused a study permit under Canadian immigration law.

I wonder, if there is a section of IRPR or IRPA which actually supports such a reason for denying a visa.

Here the IRCC is making a judgement which it is NOT qualified to make. There is NO section of IRPR OR IRPA which says a person's study plan should be "reasonable". And IRCC is not qualified to judge a person's interest in doing a course as reasonable or non reasonable BEYOND the basic expenses.

All that section says is following :

  • 216(1) Subject to subsections (2) and (3), an officer shall issue a study permit to a foreign national if, following an examination, it is established that the foreign national
    • (a) applied for it in accordance with this Part;
    • (b) will leave Canada by the end of the period authorized for their stay under Division 2 of Part 9;
    • (c) meets the requirements of this Part;
    • (d) meets the requirements of subsections 30(2) and (3), if they must submit to a medical examination under paragraph 16(2)(b) of the Act; and
    • (e) has been accepted to undertake a program of study at a designated learning institution.
The "will leave Canada" part ie "216 (1) (b)" does not stipulate a person to have a "reasonable" study.

If I have enough money to spend in pursuing my studies then who is IRCC to say that my study plan need to "reasonable". "Reasonable" is dependent upon individual's situation. Financial, personal and professional or business. A person with enough funds and possibly source of income will not find themselves desperate to illegally stay in Canada to recoup their expenses by doing minimum wage jobs.

Just curious to know, how did you come to that conclusion that OP will not leave ? Did he mention anywhere in his application/SOP he will overstay his VISA and stay back ? Do you know something that we dont? Serious question.
