Study Permit Refused in Stage 2 for Stage 1 Reasons

Hi, please see the time line below:

Sept10 - Got Stage 1 clearance
Sept 12 - started first semester online as adviced. Fees payed for entire year.
Dec 2 - biometrics requested
Dec 5 - biometrics submitted
Dec 18 - Cleared First Semester in school
Dec 19 - Stage 2 rejection

• I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR, based on the purpose of your visit.
• Given the applicant's previous education and/or employment history, I am not satisfied that the motivation to pursue this particular program at this point in time in Canada is reasonable. Refused under R216(1)(b).

Why did he get rejected for Stage 1 reasons when they gave him the go ahead to enroll?

please share your thoughts. Any guidance on next steps is deeply appreciated.

Eligibility might get re checked before clearing stage 2. Some AIP holders only got AIP from junior officers in countries with high number of applicants. Only GCMS notes can confirm this.

I am so sorry for this, I hope you can get a refund. Share more details about your profile so others can help.

To others, understand that this a rare occurrence, as most AIP holders got approved or in process to be approved.

Thank you for your response. The applicant applied in the same field of studies based on their background and work experience.

What I do not understand is the lines on AIP which clearly state that the documents have been reviewed and based on that they cleared the eligibility requirements. Additionally they recommend commencing studies online.

This is unbelievably inaccurate and wrong on many levels. Not only has this cost my brother the entire fees for the semester but also the distress.

It shows 31 days processing time for GCMS and now we are unsure if he should continue second semester starting on Jan 18 online while we request a review.

You can request a review, perhaps others can guide you here as I do not know much about it.

What probably happened is that the junior officer issued the AIP with a "Recommend Pass" but senior officer issued the rejection...

Which VO was that, must be from Ottawa ? Take note of their id from the GCMS history if you are going to sue them. They have crossed all legal boundaries. The court shall teach them a lesson. Send a notice in the web form along with reconsideration request, many have got approved after raising a web form.
AIP is still statistically safe, such refusals are a rarity.

Ones who got refused after AIP (BELA) had recommend interview or glitched/blanked out status before AIP. It's possible to receive an AIP with recommend interview status. Don't jump into conclusions.

For S1, recommend passed is good as passed, EE definitions cannot be applied for S1.

This gets even more strange, they have the eligibility review date to dec. 19 which does not make sense. Also medical was provided during the initial application (See below)

We have already spent $9000 on first semester which he cleared so all this eligibility nonsense does not seem fair.

so the next steps is to send a webform requesting a review? Am I missing any other steps?

Sometimes due to sheer volume they tend to refuse certain applications and end up doing such things. Maybe they are covering their tracks ? I doubt even a GCMS copy can help at this point but it's rare for GCMS to get wiped it. That's why it's always suggested to get backup copies released even if you get approved or didn't receive a refusal to create evidence. I saw a similar occurrence to an applicant in this forum whose eligibility was blanked out before receiving an AIP. If you don't have one yet, order one.

This is not normal at all, explain in the web form covering all these discrepancies. Hopefully, it should work out. Try to get a full refund from your DLI or defer the intake.

The AIP sent on Sept 10. clearly states that the candidate met the eligibility requirements. On top of that the first semester is now done and I cannot see the DLI refunding the 9k paid for first semester.
The second semester starts on Jan 18 and I wonder when this is being reviewed, if he can continue the course. This has been such a mess and no degree to show for and only $ lost.

The concern with deferring the second semester is if they would need a fresh application.

I am not sure how hopeful we should be using the webform process and if at they even reconsider and reverse decision. Once again, thanks for all the info and help. Any guidance helps at this point.
