Study permit refused, can I appeal ?

Hello guys,

I recently learned that my study permit's application was denied after I applied online from Algeria.
The grounds on which my application was refused are:

"• I am not satisfied that you will leave Canada at the end of your stay, as stipulated in
subsection 216(1) of the IRPR, based on the purpose of your visit.
• I am not satisfied that you will leave Canada at the end of your stay, as stipulated in
subsection 216(1) of the IRPR, based on the limited employment prospects in your country of
residence.
• Je ne suis pas satisfaite que votre programme d'études proposé soit raisonnable par
rapport à vos études antérieures et à votre parcours professionnel, ainsi que par rapport à
d'autres opportunités d'éducation locales.
"


The last point being in french (which is weird, but not so much since the application was assessed in Paris). It stands for: I'm not satisfied that your program of choice is reasonable in regards to your previous studies and professional career as well as to your local educational opportunities (not a perfect translation but close).

I was very disappointed and shocked to hear such a news. I sincerely had high hopes because I made sure my application was impeccable. In my letter of explanation, I explained my educational history, I detailed why I chose the program, the college and the province, my plans after graduation, why I'll be returning home (to start my own business using my parent's property), who'll be paying for my studies, etc. etc.

I feel like the agent who evaluated my application didn't read my letter of explanation well (which were attached to it more than 20 documents). I applied in english and all my documents were in english. However, the vast majority of Algerian applicants apply in french since it's the second national language and the applications are send to Paris for evaluation. It seems like the agent who reviewed my application was perhaps lacking english proficiency... or simply skimmed through it.

Is it possible to appeal against a study permit refusal ? I know that the visa isn't a right but a privilege, but it is unfair. I want to make sure there's nothing I can do before contacting my college and having my confirmation fee refunded. I don't think I'll be able to "reapply if you feel that you can respond to these concerns and can demonstrate that your situation meets the requirements" since I already answered and explained everything in this application.

You can appeal but not worth it. It cause a lot of money. You can defer your admission, order GCSM and reapply. it seems your planned studies wasn't matching your previous education and/or experience. You can't have masters in Computer science then opt for business(Just an example) That will require a stronger SOP. Plus, explain how it will help you in your country. limited employments sort of means the course you chose is not marketable in your country I think, explain more how it can benefit your country. Purpose of visit maybe you weren't clear on your purpose. Trust me, VO are well trained.

Your application isn't clear that you will leave Canada at the end of your stay.

Given your circumstances, country prosperity and job opportunities in your home country, it is not likely that the VO will believe what you've written in your explanation.

The VOs sees thousands of applicants each year, they can spot any irregularities in your application dossier.

If you have 20 pages of explanation, the VO probably skipped the last 19 pages

so, was your SOP 20 pages or are you saying that you attached 20 documents in support of your SOP?

There is no real appeals process the issue is closed as far as they are concerned.

The only "appeal" that people are talking about is challenging the decision in Canadian court with the aid of a Canadian lawyer, which doesn't make any sense for a refusal only for a ban. Because winning in court doesn't grant you a permit only puts the decision aside it will also take longer and be much more expensive then applying again.

So order caips notes and apply again once you understand the reasoning.

My letter of explanation was only 1 page long, but I attached to it 20 supporting documents (original and translated) so I can answer the VO concerns in anticipation.
-my educational history: I explained that I studied english after high school with the goal of studying abroad. (attached my diplomas)
-my local employment opportunities: I explained that I'm going to study in canada (vocational studies that aren't available here) and return home to open my business (attached to it my mother's property register and her ID)
-who's going to pay for my studies: my father since he was an entrepreneur, and the fact that he earned his share of inheritance after his family property was sold (with proof)
-my criminal record, my father's birth certificate.

So yeah, 20 documents, no crap, detailed everything. TL;TR? is that what the VO thought?

I think the VO decision was biased.

No one is going to believe whatever education program you're going for will "boost" your employment opportunities when you return home to Algeria. You, yourself is aware of the economic situation in your home country. Spending thousands and thousands of dollars on overseas education is not going to be worth it. How long do you think it's going to take for you to earn back the money you spend on overseas education?
