Hello,

I am wondering if anyone can assist me on this.

I recently moved to Canada (Alberta) from the States. My husband is Canadian, and we recently applied for Permanent Residency (Outland - Family Sponsorship).
I want my daughter to attend Kindergarten but, I went to register, they told me she needs to have a study permit.

We currently have visitor's status (6 months). Is there a possibility that she can obtain a Study Permit with a Visitors Status, given that we are already processing our PR?

Thanks.

1. Minor (Pre-school) don't need study permit if accompanied parents are on study/work permit.
2. No, she must apply for a study permit outside Canada.

I'm not sure but I think you can apply for her Study Permit from within Canada as stated on the above link.

Thank you for responses.

I thought that because my daughter is a minor, she would not needed (I read it on the Canada Government website).
I even showed to the person who was registering my daughter at the School Board.

She went and showed it to her supervisor, and she said that Alberta's does require a study permit for minors in kindergarten.

There are no requirements for kindergarten other than the child be in Canada. The child doesn't need a study permit, regardless of the status of the parents. As the stepchild of a Canadian citizen currently being sponsored, it is doubly ridiculous that they refused your child.

Go above their heads straight to the superintendent of the school board. Have your Canadian husband do the talking, as it can make a difference. If the superintendent still refuses, have your husband go to his MP (Member of Parliament).

As per CIC http://www.cic.gc.ca/english/study/study-minors.asp

Exceptions: Studying without a study permit

In some cases, minor children do not need a study permit to study in Canada. These cases include:

- minor children attending kindergarten;

Hello everyone,
My situation: I am currently in India with a very recently approved OWP, My wife is in Canada on a study permit.
Want to take daughter (who is 9) to Canada with me. I have seen the discussion in this group and concluded that my daughter would be needing a study permit.

How did you fill up the Custodian forms? My daughter would be staying with us and we are neither Canadian Citizens nor Permanent Residents.
