STUDY PERMIT FOR MINOR DEPENDENT CHILD DECLINED, WE ARE ON WORK PERMIT. PLEASE ADVISE HELP!!

Hi,
I am on a spousal work permit here in Canada for past 3 years approx now. Earlier my husaband was on a study permit and then this year he got his PGWP. I extended my work permit and so did our son who is 12 years old. His study permit was extended till May 1st as his passport was expiring then. We reapplied for the extension of the study permit as soon as we got his passport renewed. Yesterday we came to know that his study permit has been refused as we need to submit a leeter of acceptance from the educational institution. On relooking at the CIC website it clearly states that we fall under the exception that no letter is reqired as he is studying here being with his parents who are on a valid study/work permit. They have advised us to apply for restoration of status within 90days as his TRV has also lapsed. Please advise the best course of action- appeal/restoration application and docs required.

Yes, we ad attached the work permit of my husband with the application for extension. We are very worried now. Is the restoration application online/physical.? I do not think there will be a letter of acceptance given to us as its mostly given to international students who come here on their own not accompanied by parents. Please advise. Thanks

You can apply online. Include a letter explaining the situation and copies of your work permits.

If you ask in school they will provide the history of the child and confirm the present. I did the same to my daughters.

Sent a copy of the immigration rules along with the restoration. They are human and sometimes they are not as up to date with the rules that changed in 2014. Someone pointed out that to me just yesterday. I will try find the link. The dependent can study without a study permit so a visitor record will suffice!!?
