Hello,

I have been studying in Canada since January, 2013 and my study permit will expire in April 2014.

I have applied on CIC to extend my study permit a month ago and submitted all the documents required (passport, study permit, letter of acceptance, etc.). I got a refusal letter from the CIC today regarding to my study permit extension application, saying:

"Your application as requested is refused.
Immigration Legislation requires that every foreign national in Canada must hold a valid passport, identity or travel document. As a foreign national in Canada, you have not produced evidence that you are in possession of such a document and that it is valid for the duration of your stay in Canada.

We also wish to advise you that your temporary resident status will expire on April 30, 2014. You may apply again before the expiry of your temporary resident status if you submit:
 a completed application form;
applicable fees for the immigration document(s) in the amount of $275 payable at a financial institution in Canada or online at CIC. 
All required documents in support of your application."

I don't get it. I am still studying in Canada with a valid study permit and I submitted my passport and study permit in my application. What does CIC mean that "As a foreign national in Canada, you have not produced evidence that you are in possession of such a document and that it is valid for the duration of your stay in Canada"?

Is there any way I can appeal? Or what should I do next before I try to re-apply.

Thank you!

When does your passport expire? If your passport's expiry day is the same as your current Study Permit's expiry date, this could be the reason why you got the rejection. In that case you would have to apply for a new passport first, then apply for extension of your Study Permit. However, if the passport is valid for the time you requested your new Study Permit, then you have to make sure that you submitted your passport properly. If you did and they sent you rejection, you may want to contact a CIC agent about it.

Thanks orange_girl. My passport expires in 2019 so it should not be the problem. I have double checked the documents I submitted as well. I plan to call 888-242-2100 to speak to a CIC agent tomorrow and worry if they could or are willing to help.

p.s. If some document is wrong, CIC could require me to submit additional document, right? It is just rejected.

I know that sometimes there are technical problems in their online system, i.e. people upload all required documents but the visa officer does not see some of the documents. If it's uploaded and you can prove it to a CIC agent, there should be no problem with re-opening your case. I mean if the problem is on their side, you won't have to reapply. The CIC agent will send an email to the immigration officer explaining your situation and it should be resolved.

Thanks again!!!

Hopefully I can speak to an agent who is nice willing to help me look into my application. I hope it is technical problem and they are willing to resolve my case. It is not fair that CIC just rejected my application because they can not find the file I attached, at least they can ask me to send additional documentS that they can not find. All in all, we have paid the application fee and at least deserve a fair treatment.

Keep my figers crossed and pray!

Yes - just read the posts above yours. The OP's study permit extension request was rejected. Read that post carefully
