Study permit extension prior to spousal sponsorship

Hi everyone,

I am a PR, not meeting residency obligations. My girlfriend came to Canada on study permit and we got married here in Canada half a year ago.
Her permit is expiring soon and I'm looking to extend her stay here while I accumulate the time required.
Would it be better to apply for a college/university program and just extend her permit? Or should we try to extend her stay as a visitor, explaining that she wants to stay with me longer? Or is it better not to talk about me in the letter of explanation at all?

Another thing I heard talking to people is that if I apply inland: I can file the application several months before meeting my residency obligations, since the file won't be viewed by CIC before that anyway (I hope I was clear on this..). Is that true?

Thank you again for your help.

And yes, I spent a lot of time thinking which forum to post this on, still not sure :)

If you apply to sponsor her before you meet your RO, you application will be denied and you've now put yourself in the spotlight for not meeting the RO, even if you have since met it after filing the application. You don't want to burden yourself further with that paperwork they will dump on your head after that.

If she wants to continue to stay, either extend her study permit or change it to a visitor visa. I wouldn't go into great detail regarding her 'boyfriend' or it would likely be denied.

Good luck.

Thank you for your clear answer, Alurra71.

So when I accumulate 2 years I can apply right away? Or do I need to apply for PR renewal and do it only then?

I understand that this question was probably answered multiple times on the forum and I'm trying to sift through 300 pages of threads but even one page takes hours to read.. I appreciate all the help.

Yes. As soon as you are sure you meet your ro you can sponsor her immediately.
