Hello everyone. My first programme was completed on 28th of August, and my study permit document expiry is 31st of December Which means 16 days are left.
I have not applied for a study permit extension yet, though I have got an LOA from York university and I've paid initial deposit of 5000CAD to secure the admission.
Am I eligible for study permit extension? Or do I need to apply for restoration as well? Will I be able to start my second programme starting from 9th January :(
Please help me out if anyone has been through similar situation

Your permit expired 90 days after program completion so November 28. It is either date of program completion or expiry, whichever comes first. If you didn’t extend study permit then you have been without status in Canada for weeks. You cannot restore status either because it is past 90 days. You need to apply for a new study permit outside Canada.

Are you 100% sure about it? I talked to one agent and he said if you are going to continue your studies then this doesn't apply and since I have an LOA it should not matter. This 90 days rule is only applicable if you are not planning to study or you didn't even start the program.
You should start the second program within 150 days after first one is completed and that's what matter.
I'm so confused right now.

Yes…see link below. You didn’t extend your permit within the 90 days. When your studies finished, you had 90 days to extend your permit and maintain status. You didn’t do it. Rules also changed on November 1 and you need to apply for a new study permit. You cannot extend anymore. Having a LOA makes no difference. What agent did you talk to? If through IRCC call centre, then information is not always correct.

Your study permit will expire on whichever date comes first:
  • the date marked on the permit or
  • 90 days after the day you complete your studies
If you can’t prove the date you were first notified by your school, we’ll use the earliest issue date on the document. We may confirm this date with your school.

Ok. Rules changed on November 1, and you need to apply for a new study permit unless you haven’t changed schools. All the best.
Alright, I just talked to another RCIC approved consultant. And he said similar things to me and asked not to worry about and he asked me to attach a letter of explanation with the study permit extension with linking 90 days and 150 days policies. Also he asked to pay restoration fee as a precaution(but not to apply for it). I believe this is something which is not so clear in the IRCC guidelines. Because IRCC mentions that person can start another program within 150 days of first program completion which means the first permit would always expire after 90 days.
I just wish you are wrong and I get SPE. I don't have other option rn. I can apply for PGWP but that would mean I can not work until I get the PGWP which takes 5-6 months nowadays.
