Study Permit along with dependents

Hi All,

I initially wanted to pursue my MBA but since I hold a three-year degree, most universities don't accept this. Hence, I have decided to enroll into a post-graduate degree certificate which a one-year course.

I have no issues with universities, as that is moving forward as planned. However, I am a bit concerned in regards to study permit and visa for my minor children.

I have read various reviews and rejection details on study permit. I intend to take my two young boys with me for study so that they can be with me, as my husband will be working here, and I wont have anyone to look after the kids.

Some say that if you apply for accompanying dependent possibility is of rejection, as this is looked as migration to the country.

How can I avoid this situation, is it advisable that I first apply for my study permit and then apply for my children visa, but we all 3 travel together. However, in the family information form it states under the children section if my children will accompany to Canada if I tick No first and then will I be able to apply for my kids.

Please help as i need some advise on this.

You have to decide whether it is essential to bring your kids with you and what home ties would you still have if they are with you. Most likely they would be refused if you apply separately for the kids. Also you have to think whether you guys as a family have done travel to the visa-required countries (like the US or Europe) and came back. You might be in a good position if you apply for the kids as well and mention that you will definitely be back to the country of residence to reunite with your dad and your study will help you in so and so ways back home.
That requires strong sop and enough finances to show that you guys will be good and won’t overstay

Actually that’s not good that you guys are in Dubai. Is it a permanent residence? If not, you would be better off applying directly from India

You should apply from India and not Dubai as chances of refusal are high when applying from a country other than your nationality.

I am guessing you will have to apply for the kids along with your application, how else would they get in?

Yes permanent residence, since we are born and bought up here. So I don't know if it is a good idea to apply from India, specially the COVID situation in India.

Can I apply from India if I am not in the country for a long time, since I am NRI.

However, the agents out here are saying that I can take them to Canada only once i have travelled there and then call them later - which doesn't sound like a plan to me.

Yes, that is another way. Because many people nowadays are trying to migrate to Canada somehow and these immigration officers know about this very well. There are many rejections in Study permit although their economy depends on Int. Student but still they are strict in issuing permits. They can easily identify that first, you will go with your kids, and later on, your husband will apply for a visit or spouse visa to join with your family and settle there. Anyways, I am not discouraging you but showing the issue might arise, you better think twice because your case is too risky.

It depends on your SOP. How strong you present your situation makes your case stronger. I myself applied for study permit along with SOWP for spouse and TRV for kids. I am an Indian but residing in Saudi Arabia. I got my AIP in september, and now waiting for second stage approval.
I would say explain everything in your SOP, Y u want your kids to accompany you and how you will take care of the kids when you are in Canada? Also make sure your past education, work and your future course are in tune with each other. Show them that pursuing canadian education will lead to career progression.

If Dubai is your country of permanent residence, then it makes sense to apply from there. Make sure to explain why you are in Dubai and whether you are going to return there after your studies. If you have a good travel record of not overstaying anywhere and always getting your visa, then I would encourage you to apply with children on file. Otherwise you risk to be separated and it is good that your husband is staying behind.
Once again, write a strong SOP. Maybe hire certified visa consultant in Canada to look at your SOP before applying, not to apply for you. Make sure you show good amount of financials on file. If you are a genuine student, then it will all work out

The most important thing you would need to stress on is ties to country of residence supported by appropriate documents.

Thanks for highlighting, so I was planning of showing property documents for ties to home country, but did not think about ties to the residence.
Since, my husband will be here in Dubai, will that work out.

Leaving a spouse/kids back-home/not accompanying you. Leave of absence from employer. Property/assets on your name are a few things I can think of as ties. Especially since you're a UAE national. It shouldn't be a problem.

I mean from my personal experience, I have seen people from developing country having issues with home ties, than from developed nations. But if I were you, I would have preferred being on the safer side by providing ties documents.

Me and my family are also thinking on the same lines. We also have two kids aged 4 and 2 respectively.
Would like to know your method of application wherein did u apply with your kids in the single application.
Being a mother it's very hard to leave my kids at this age, thereby the question.
