Hi guys, I really need your help and advice. So I got a decision today and it stated that the study permit has been refused because of the following reasons:

1) Not satisfied that I would leave after my study and 2) insufficient financial status (this can be fixed) but how do I convince them on their opinion of me not leaving after study?

secondly, my hubbys permit was refused because of the following reasons:
1)Not satisfied he would leave after and 2) “the purpose of your visit is not consistent with a temporary stay given the details you have provided.

thirdly, I feel the visa officer wasn’t patient with our application cause his biometric is yet to be updated and the date on medical review states 30th of Dec when today is still 29th.

please help

Refusal can be given prior to refusal.

1. What is your program and length?
2. What is your profile - age, education, current job
3. How much in funds did you show?

To get a study permit you need to show progression in your current level of education and career (higher pay, promotion) to justify costs. A SOWP is not guaranteed so what did he show as ties to return. What did you show that after studies, you will have better career opportunities. Your spouse, not applying for SOWP, is a tie to return too.

My program length is not determined yet because it’s an open study.
I did not include my education and current job in the application.
the funds were initially sufficient but due to the fact that dollar has been rising against naira in recent times, the value has reduced but I intend to add more money to it next week.

How do I explain my hubbys purpose cause we submitted a fully detailed SOP with the application?
Also, do I have to reapply or can I appeal?

Orider GCMS notes. What do you mean it is open study? What is the program and school? How much is the cost of the program? How much in funds do you have as proof of fund rules have increased? You must pay first year tuition.

What did your SOP stay if you didn’t include your past education and job aspirations? You need to include an SOP describing why you need to come to Canada and take this program. You need to describe how the program builds on your education and current job. You show that by taking this program, you will make xx more per year to justify costs.

A SOWP is not guaranteed so if your funds are not enough and your program is not building on your education then his chances are weaker. If you apply alone then you have a better chance because he is your tie to return.

This is not an appeal. You reapply.

To be safe do you think I should re apply myself or get help?
What is the school and program? That can be a big factor for your refusal. If you have kids in Nigeria, then show custody agreement showing that your husband has shared custody. You can apply alone.

It’s an open study. It is flexible and you can combine classes of your choice to determine degree
Then that is an issue. You need a LOA from a DLI with a program of study and length. How long is program for a degree? How will you show career progression with open study? If doing a degree then what education do you have already?

Open study is for a year, usually you transition from open study to nursing. There is LOA and DLI. I already have Bsc in Psychology. The cost of study requested by school is 16,000 and another 11,000 for expenses but I forgot to add the 5,000 for travel expenses. I don’t think they have issues with the school or program. I think it’s more of the funds.
Also, my current and past occupation is clearly stated in the study permit form.
I honestly feel the rejection was an error by the VO and the application wasn’t properly reviewed. First the date which says 30, when it’s clearly still 29 and Canadas time zone is even way behind Nigeria’s. Also, I paid for biometrics for my hubby even though he already had one done and they didn’t update, request he takes another biometrics or even refund.

Your first reason for refusal is 1) Not satisfied that I would leave after my study. That could be the program you are taking. If you want to take nursing then apply to nursing. if you have a BSc in Psych then you should be building on that with a Masters, not taking another degree. Order GCMS notes.

You must show that you have paid first year tuition and a minimum of $20k for one person.

I don’t think it is an error but if you do then look at reconsideration. You don’t have enough funds for a 3 or 4 year degree, and your program choice makes no sense to your current education.

The nursing degree is a 2 year course and since I don’t have background in nursing, that is why I am taking the open study first. I can’t pay a full tuition until after I have registered my courses as that’s what will determine my total fees. I agree with you that my funds is low and I will work on that. Quite unfortunate given the new policy but I’m passionate about it.

As for my husbands, I know I won’t be able to do well by myselfbecause I have never been away from home or from him. I have all my family in Nigeria so I wonderwhy they think I don’t have enough ties to my home country.
If it was possible for my company to give a study leave I would have requested for one but they don’t

With Open study permit, it is very hard to sell in front of VO, especially coming from Nigeria. Secondly, there is no career progression since you dont have background in Nursing and you hold another Degree. Those two factors plus POF are the reasons for your refusal and you need to work to overcome them. Key line, "Not Satisfied you will leave Canada and Purpose of Visit"
