Student stopped studying Last year- Can I join new course on same Study Permit

When I was student I worked 20 hours a week for this same employer. Because he liked my work he gave me LMIA after I told him I stopped studying. I did not work illegally after May 2021. I stopped study and work and waiting for LMIA approval.

My study permit and TRV is valid till 31 December 2022. AM I still illegal here after May 2021? No one told me that

You can only apply if you can show compliance with the reasons for refusal.

If you haven't been studying since May 2021, what is your status in Canada? What have you been doing for the past 10 months? Assume you are in Canada without status (illegal) if you didn't change status to visitor. What is the job/NOC? What did you show that you can do the job - employment letters, pay stubs.

Your study permit is only valid if you are studying. It would have been cancelled months ago as colleges/universities must inform IRCC. You have been in Canada without status (illegally) since May 2021. No one has to tell you that. IRCC is not responsible. You are responsible for knowing the rules. It is clear that you must be actively studying to maintain your student status. Not sure if you can even restore any status because it has been more than 90 days. You can't reapply for a work permit because you aren't in Canada legally.

What is the NOC? How are you experienced to do the job (not the employer who gave you LMIA)? You must have past references/employment letters to show that you can do the job as outlined in the reasons for refusal.

Your situation is very messy. Here's where things stand:

- Since you dropped out of school so long ago, chances are high your study permit has been canceled by IRCC and you're in Canada without status / illegally.
- Assuming your study permit was canceled last year, it's most likely too late to restore your status from inside of Canada.
- The TRV does not allow you to remain in Canada legally until December 2022. That's not how it works.
- You can certainly try to change your status to visitor or let IRCC know you are changing schools and programs. However if you try to do one of these things and you're already out of status in Canada, IRCC will refused you and tell you that you need to leave the country and go home.

That's where things stand for you.

My employer gave me LMIA. I was waiting for LMIA approval and applied for Work permit in October 2021 and received refusal for it yesterday

Don’t quit yet. And whatever you do don’t go back to your country if you do you may never see Canada again. There are many ways for you now such as a judicial review, H&C PR if you have been working even illegally. And many more but I am not sure yet. There was a girl just like your situation I think she did a judicial review and won. Just whatever you do don’t go back to your country if you love Canada.

I am confused
I thought that if status expired beyond 90days you cannot get anything at all because you are in the Canada without status.
That the student has violated their rules
That officer is not allowed to restore status in Canada.
So how can you get PR if working illegally, because that comes with a 6month ban.
That IRCC will know by SIN number
