Student permit holder- adding spouse to get open work permit

Hi,

I got approval in a post secondary institution in Canada and got my study permit for a 2 year program.

I have a question re: spousal work permit.

My husband is currently on visit visa in Canada and I would like to add him as a dependent. It is my understanding that spousal dependents get open work permit for the duration of my stay in Canada. Due to a personal situation we are planning on leaving to India next week. My question is can he come back on visit visa and explain the immigration officer at the border about extending the stay by applying for an open work permit while being in Canada ? Will it cause any problems for him if he did that ?

I have read several forums where I got mixed reviews, so I just want to make sure I understand if there is any issue doing this. Please let me know.

Generally you cant apply for your spouse only after you have completed 6 months of full time studies. People who come here on visitor visa can re enter canada if the visa allows re entry. Or he will have to apply again. He can get open work permit only if you have open work permit. Or only after you have completed 6 months of studies

Hi,

Many thanks for your reply. He has a multiple entry visitor visa till 2018. I suppose that makes him eligible to re-enter Canada, but will he have any problems at the port of entry ? Ofcourse, he doesn't intend to work in Canada without a work permit, but atleast I am hoping this situation will not create a lot of suspicion and fuss with the immigration authorities at the border.

Also, is there a rule somewhere that says he is eligible only after 6 months of studies. Does that mean if we apply say a month after I join, there are more chances that it will be denied.

Hi I need your help. I currently have post graduation open work permit. My fiance he is in student status in canada. I f I get marry him legally from canada, can he quit his studies and change student status to open work permit status.
