Hello. I have been in Canada for over 7 years with my Study Permit. My Study Permit will expire in September 2012. My Canadian girlfriend and I are planning to get married this July.

My question is: If I apply for PR in July after the wedding, the process will take about a year, then could I still stay in Canada after my study permit expires during the process? If yes, what is my status? can I still go to school as international student while waiting for the result?

Who have been to this case or who knows about this, please answer me. Thank you!

After marriage your wife should sponsor you to get your PR. Then your status will be changed accordingly on approval of PR application. An out land application will also take time. Therefore you should apply to renew your study permit if you want to study longer. It is important to apply well before your current permit expires to ensure your permit remains valid. Check whether you are qualified to apply in Canadian Experience Class category.

My name is Nitin Krishna.I came to Canada in 3 yrs study permit on Aug 28th,2012.I studied Animation at Cambrian College for the first semester and changed to graphic designing at the second semester.I did one year over there and I dropped out of college due to some financial backdrops back home so i worked instead of going to college but I was still in my study permit and so I didn't go the college for 2nd year and In 3rd year that is 2015 I took a course at Centennial College Progress Campus.I did one semester over there but because of a financial crisis my family wasn't able to support and i wasn't able to come up with enough money for second semester. My Study permit is expiring on this 31st August 2015.I want to stay in Canada and finish my studies I know that I am late and running out of time.I don't want to jump to conclusion my family depends on me and I ask your help. The below is a detailed structure of my 3yrs stay in Canada starting from Aug 2012-Aug 2015

Aug 28,2012 Came to Canada on a 3yrs Study Visa
Sep 7 2012 Started studying Animation at Cambrian College Sudbury
Jan 1 2013 Changed program to Graphic designing at Same College Cambrian College
After I year at Cambrian dropped out of college still in Study permit of 3yrs.
I went to Toronto stayed with my brother (Amar Krishna) who came on Jan 2013 and worked there part time for four months.
And on September 2013 I came back to Sudbury Worked there to earn money for College and for helping my family back home.
Stayed in Sudbury until Jan 2014.Went to Edmonton at my relatives place stayed there and worked one year and didn't go to college.
I came to Toronto on Jan 2015 took Business Administration at Centennial College 2yrs.

Studied one Semester and couldn't complete the second semester because of not enough tuition fee I worked with out no choice My Study permit expires on Aug 31 2015 the authorities at college are not quite helpful and I missed the deadline right at the moment I am taunted by the fact i have to leave the Country once and for all.I know I had options but at this stage it is not by far the best way to tackle my problem.I look forward to you for your advice and assistance to legally stay in Canada within 1 month or before Aug 31,2015.I am so much in absence of mind i only seek to stay in Canada and this time I want to complete my study permit. Is there by any chance that I can get the guarantee that if I finish my studies and I would be eligible for PR in Canada.
Thank you for taking time in reading my Mail.I have made mistakes but I need a second chance my family depends on me and my brother.I know this must be a slight odd scenario of international student.I urge u to help me and guide me towards the wright direction.Thank you.
Nitin Krishna.

There is no guarantee that you will be able to stay in Canada or qualify for PR. I suspect the fact you have engaged in so much illegal work means that CIC is going to tell you that you have to leave Canada and return home.

Am I right in understanding that your study permit expired on August 31? If so, did you apply to extend your study permit before it expired?

Just because you have a 3 year study permit doesn't mean you can just drop out and start working full time. You did not fulfill the conditions of your permit.

If you apply for a new study permit before your current permit expires, you will be on implied status. Otherwise you can apply to change conditions to visitor in order to stay in Canada while you figure out a study permit. Otherwise, you can apply to restore your status within 3 months of going out of status so until the end of November this year.

However, it is not guaranteed that you will be granted a new study permit as you have been here 3 years and not completed a course yet as well as you dropped out and worked full time against the conditions of your permit. Why should immigration believe you now that you are planning on completing your studies? You already had your chance.
