I'm currently in Canada on a closed WP. I was recently terminated due to project unavailability with my current employer. My WP and TRV will expire in Jan 2013. Now I've new a offer from an employer with approved LMO. I have already applied for New Employer WP online on CIC website. If my WP is approved then good but in the case of WP is declined then what are my options?

1. Do I need to leave Canada in Jan 2012 before my TRV and WP expires?
2. Am I allowed to stay in Canada until May 2012 (90 days after visa and work permit expires)?
3. Is is illegal to stay in Canada after my Visa expires?

On a side note I'm currently in Canada for about 3 years. I've already applied for PR in May 2011 it's now in process my Ottawa CPP-O. I don't have my medical yet.

1. You can stay till you receive a response from Vegreville.
2. Technically you can stay 90 days after you received a refusal of your WP application.
3. Yes, but you should have a valid WP or application in process.

Appreciate your response. Not very clear on these...

2. Technically you can stay 90 days after you received a refusal of your WP application. -
3. Yes, but you should have a valid WP or application in process.

2. My Visa and Work Permit both expires in January. Even though my NEW WP is denied by end of November (This month). I should be allowed to stay in Canada until April 2012? 1. Is it legal? 2. Will it complicate my PR application later?

3. If I don't have any job offer by the January then do I need to apply for Open Work Permit or Visitor Visa to remain in Canada?

Thanks

Hello,

My 1 Year post grad work permit is about to expire (in 3 days) My employer applied for LMO an today I got refusal.Reason was "low wage" compared to Canadian workers.I have also applied for work permit extension 15 days before my visa expires but I am assuming it will be denied without valid LMO.
I would like to apply for restoration of the status once my work permit gets rejected, before that my employer will increase salary and reapply for LMO.
My questions are
1. Am I on a right way?
2.Do I have to wait until my work permit gets rejected and then apply for restoration or can I apply before that?
2.How long the process of restoration lasts?
3.What is the percentage of getting my status restored?

Any other advise?

Thank you in advance!

Not even end of November and you're assuming it's going to be refused? :) Anyway, if your WP expires on January, 2013, you have 90 days to apply for restoration of status and apply for another WP or change status to visitor. Restoration, change of status may or may not be granted. You can stay legally while waiting for the response.

BTW why do you think your application for WP is going to be refused?

On what basis are you applying for OWP? As for the visitor visa, you can but you'd have to apply outside Canada. If you apply at Ottawa, it would be co-terminus with your current WP and you should have an employer if you do that.

Not sure if it will be refused or approved. But I'm preparing for all options. Thanks for your reply.
