Statutory Declaration: Common Law Union

Hi,

I am Italian and I'm applying with my companion for the sponsored visa as common-law partners. At the moment we are working on getting the Statutory Declaration: Common Law Union form notarized by a commissioner of Oath but I still have some questions about the form and I'd like to get some advice from people that have done the declaration before.

Me and my partner have been living in UK together for more than a year, till the March 1st 2014 when his visa finished and he had to come back to Canada.

I came to visit my partner here in Canada on the 29th of March 2014 and then we opened a joint account as we need to move some money between accounts and it will be useful during the time I'll have to stay in Italy waiting for my Visa. Now on the form it's asked if we have a joint account and I think I should put yes but we didn't have this account when we were cohabiting, is that considered a valid prof or is consider valid only if it was open during the cohabitation period?

On the form for the Statutory Declaration: Common Law it's asked and address, do we have to put the address of the place where we are staying at the moment? I saw on the form that it's asked only the start and end date of the cohabitation but nothing else, do I have to add a second paper stating that we cohabited in UK and not in Canada?

Last question, we have more prof of the relationship but we need to use those for the visa request and we can't use them for the declaration as from what I've been told if we put those in the declaration the documents will be sent to an office and we wouldn't get them back, is this true?

Hi

As stated in the guide, the Statutory Declaration of Common-Law Union is only required when the partner is a co-signer in the application. As the sponsored partner, you cannot be a co-signer. This means that the Stat Dec is not required.

It is not required but it can be presented as prof of the genuine relationship and I know from other couples that applied the same way that it helped a lot as is a oat and is legally bounding. I want to present it but i have this questions about how to fill the form and co. Please reply only if you know the answers of the questions. Thank you.

Just fill out the form with the correct information... date of cohabitation: when you first started living together to the time you gonna sign this declaration letter , in the proofs of cohabitation, just check whatever you have, you don't have to pass those documents you don't even have to show them... trust me I made this before... I'm from Alberta...

Thanks Nezya, but we have been living together in UK till last February and now he live in Canada and I'm here just as a visitor, with a month of separation and me being here just as a Visitor I don't think that I can write that we are cohabiting at the moment. This is the only doubt I still have.
