Hi,

I have a query regarding my PR status. My husband (canadian citizen) sponsored me while he was in his home country well i got my visa then i entered in Canada and now i have PR(june 2018). We both were and still outside canada(in our home country) due to work.
In the mean while (4 months back) things were getting worst and we ended up taking divorce . Now i need to know what is my status in Canada?
Can i go and live there alone? what will be my status?can i become canadian citizen?
We were planning to live in Canada in 2018 end now i am nowhere.

Thank you so much for your reply.

1.If i can go and live there what will be my status at the time of applying for citizenship?because i got my visa due to family sponsorship but i have no longer family or that relationship.
2.Whether he(my ex husband) can cancel my PR?if he will get married to another lady(then he needs to apply her PR card)?
3.Can i get married again and sponsor my husband? and for how long i can stay outside canada after getting my PR card?

1. Your status is still PR. after 3 years in Canada you can apply for citizenship. Getting divorce wont effect your status.
2. Your husband cannot cancel your PR so dont worry (unless he can prove it was a fraud on your side but its a long and complicated process so i really wouldnt worry about it)
3. You can get married any time you want, but you wont be able to sponsor your husband for 5 years
*To keep your PR status you have to live in Canada 2 of the last 5 years. So you can live outside Canada up to 3 years. Longer than that and youll lose your PR once youll try to go back to Canada.

Expect a lot of scrutiny on future application unless you had been married for years before applying for sponsorship. Getting divorced months after landing and having never lived in Canada definitely raises red flags.

Thank you for your reply.
i got married in june16 (outside canada) we started to process our application in April 2017 , i got my visa May 2018(land there immediately and go back to my home country within a week) and got PR card in June 18(while outside canada) now i am getting divorce in May 2019(almost finalise).i am still outside canada and planning to go there.
We were planning to move there in January 2019( that was the initial plan with my ex husband) but now i need to know the status so i have to plan accordingly.
1.Whether i can go and live there and also eligible for citizenship even if he cancelled his SPONSORSHIP UNDERTAKING?
2.When can i able to sponsor my future husband?

Can you please advise me after all of this will i have any problem in future?

1. Yes you can live in Canada as long as you follow the residency application.
2. 5 years from your landing date. Given that you separated soon after landing that is always a red flag for any future applications.

He CAN NOT cancel his sponsorship undertaking. Divorce or separation does not release him from it.

While everything is legal if youll apply to sponsor a new husband, you got sponsored, did a landing, went back home right away, got divorced, and then wait the 5 years to sponsor a new husband. This is a huge red flag and it will be checked very very carefully. It doesnt mean it impossible but as wrote here before it will be a longer process with lots of poofs and interviews,

I am not even looking to sponsor a new husband . i wanted to know the situation i am putting myself into.I was thinking whether to move is a good idea or not because i will be all alone and can not even get married soon.
Well my marriage tenure is almost 3 years and that was not a good experience. I also heard that if someone is abusive then government authorities will support you rather their citizen.

What is the better time period to search for a job?Finance jobs

Not sure what you mean about Canadian "government authorities" supporting you instead of a citizen. If you are referring to the police, they would need evidence before they could makes any arrests for abuse. Given that you and your spouse haven't even really lived in Canada together, it is unlikely that Canadian police could do anything. You would need to report it to authorities in the country where it happened.
