Hello! I'm a U.S. citizen on disability. I want to immigrate to Canada to be with my partner, but I am unsure how to go about it. I've applied for PR before, but the process was stalled and eventually cancelled.
I know that things have changed since I applied last, and I want to be sure that I'm filling out the right type of application for my circumstances so that I'll be able to cross the border without any issues. I can't really afford a lawyer, so my partner and I are putting our heads together to find solutions.
I have been to Canada previously, several years ago now, in a previous relationship. I had applied for PR at that time, but the relationship ended as I was in the middle of the process, so I returned to the U.S. The previous application is now cancelled.
My current partner is a Canadian citizen, living in PEI. We have been together for six months, and I just returned from a visit there last month. I'd like to be able to return there possibly by next summer, if I can get everything done properly.
I hope that this forum can provide some helpful avenues to make the process easier.

You need to be married or qualify for common law before you can apply and it sounds like you don't meet either.

I don't want to arrive there and start the process of PR only to be told by authorities that I'm not allowed to be there because I don't have the proper documentation. I need to know if I should return there for another visit, and while there, apply for the PR? The government website is tricky. My partner and I found an application for a visitors visa, but this also has to be submitted while I'm in the country, as well.

It doesn't guarantee that I'll have any rights in the country. I just want to return there to be with my partner, and I need to find a way to do that within the proper boundaries. Again - you either need to be married or live together for a full year before you can be sponsored for PR. Until you do one of these things you cannot be sponsored.

You can't return for a visit and apply. You need to be married or qualify for common law. Because you're from the US, a way to do that would be to come to Canada as a visitor - you're allowed to stay for 6 months. You can extend your stay once you're coming to the end of that to make it a year and qualify for CL.

The only way to come to Canada is if your "married" or in a "Common Law relationship". What qualifies you to be in a Common Law relationship is if you can prove to immigration that you have been "physically" living together for "over" a year. This means showing what ever you need to show that you have been "physically" sharing a roof.

If your planning to get married, then you need to show the history of your relationship, marriage certificate and evidence that family and friends know that your married. Married couples show pictures on social media, such as Facebook and Instagram, plane tickets with your names on them, train tickets with your names on them, text messages, emails, phone calls to each other, cards, money transfers, insurance shared, bank accounts shared. etc.........

The most difficult is to prove to a visa officer, is that your in a common law relationship. Good luck!

Given that you are familiar with the process, what specifically are you looking for from the forum members, beyond what had already been provided?
