Spouse Visa- refused study permit twice.. will it cause any issue

Hi Friends,

I have few questions on spouse visa.

I will be applying it for my wife, I was dating her for about 2 years and we will be registering our marriage In India.

Now the issue here is that she was earlier refused study permit twice and she had also earlier enrolled herself for express entry -its now expired, will this cause an issue for us now?

Also, can anyone let me know what kind of evidence I would need to show. is anyone aware how long this would take?

Please advice.

I have seen one case from 2015 applicant who got interview due to previous attempt for study visa . But all cases are different.Do provide lots of proofs, photographs, wedding expenses bills and communication to avoid any interview.

Her refusal history might be a problem, especially if all these refusals were BEFORE you guys started dating, because this shows she has a strong desire to come to Canada, and could potentially be using you as a means to get there.

But if the rest of your relationship background looks good, you should be able to succeed in the interview when you guys get it.

yes, she tried for Express Entry and for the study permits while we were dating.

She wanted to come by herself first(during our dating period), that was the plan since our relationship was just 6 months old when she first applied for express entry.
When she comes here anyway I would want her to study so she applied for the study permit too, but it dint work out. So she definitely dint use me as a means to get here.

Do you think it could still cause some issues??

If it was my case, I would be expecting an interview to prove a genuine relationship. They will see the previous attempts to come to Canada, and they might question the relationship as one of convenience. That said, I would be preparing everything I could, saving receipts, documenting everything so that CIC could be proven wrong...

My husband's study visa was refused twice in the past. We started dating after his visa refusal. So, we were sure we had to face to interview to prove a genuine relationship. Before submitting the documents, we collect all the proofs, pictures...

At the interview, the officer asked many questions about his previous attempts to come Canada. Then my husband tried to prove our relationship is genius by explaining his study visa refusals and our marriage are not concerned. He wanted to study abroad to get the good job after he come back VN. After dating, we love each other and we want to stay together. That's why we married. (Actually, we knew each other when we were kids. But just dating for 6 months before we married). My husband's interview went well and his landing will be next month :D The waiting game is over.

Honestly, we didn't expect much when we applied because his previous study visa refusals. But I found a lots of recommendations, supports, courage from this forum and it makes us more confident! Thanks again,
