Hi everyone, I need a quick advice from all the lovely members in the group.

My husband is a PR holder and he has gone to Canada three weeks ago. He got his PR in 2019 but due to Corona he had to come back to his home country. Now that he has a job in Canada he has again gone back in order to fulfil two years criteria.

We got married in July last year, and I don’t have any PR or tourist Visa of Canada. Should I apply for spouse visa or there is any other visa feasible? Also is there something like spouse open work permit? Lastly, if we are proceeding with spouse Visa is there any requirement for my husband to show past 12 months financial condition (he was not in Canada but had a job in home country)

Was your husband outside of Canada for more than three years since he landed in 2019?
 

OK - that's good. So there are two options in that case:

1) He sponsors you for spousal sponsorship through the outland application process. This means there is no need for you to be in Canada in order for him to sponsor you. There is no open work permit granted with this process.
2) You get a TRV and travel to Canada. Once you are in Canada, he sponsors you through the inland (inside of Canada) application process. If you do this, then you can qualify for an open work permit.

this link has something which says that “your available income is the amount of money you have earned in the period of 12 months preceding the date of your application”

but since my husband just went there, he can only furnish details of salary received in home country and not that in Canada. Is this fine?

2. There is no income requirement to sponsor a spouse.
3. No, you can't do this. It doesn't work that way. If you want a work permit, you have to travel to Canada first and apply for spousal sponsorship from within Canada. If you submit the spousal sponsorship application while you are still oustide Canada, then you don't qualify for an open work permit.
