Spouse Trv Extension & OWP

Hi,

I am working on a PGWP in Ontario, my wife came to visit me on a multiple entry visa in August and she is eligible to stay till Feb. I ll be applying to extend her stay here but i wont be getting the response back before Feb. I have read on CIC that she can stay here on a bridge visa till we hear back from them. But i am not sure how will this all go through...how much time will i have after getting the application response to arrange for her tickets if God forbids the application is rejected?

Secondly i have also applied for her OWP, i wanted to ask can she stay here if her OWP application is accepted beyond Feb or she will still have to leave? Because i know from PGWP experience that with a work permit you can certainly stay but i am not sure my wife's status in this case.

Your help will be highly appreciated....

No such thing as Bridge Visa.

Use common sense. A week or so is enough to wrap up and leave.

I don't get this question. A WP (any kind) enables you to stay and work until the date written on the permit.

When you say she will have one week is that some arbitrary time period or CIC will tell us that you should leave Canada by this and this date?

Something arbitrary. The notice will say "you have to leave Canada immediatly".

And arbitrary will be the judgment used by CBSA officer to determine if she overstayed or was negligent to the leave notice.

As she has already applied for an OWP, there is zero point in applying to extend her visitor status as well. Wait for a reply on the OWP app. If she hasn't heard by the time her current status expires, she will have Implied Status allowing her to stay until CIC makes a decision on the OWP app.

I think we will soon get a response for her OWP app, If in case it is rejected and she still has few days to stay in Canada do you think will it be good idea to apply for her stay extension then?

Provided her current status is still valid, yes, she could apply to extend her visitor status. However, if the OWP is refused, there is a good chance that the visitor extension would be refused as well.

Hi

Did you face any challenges in getting your wife over on just a trv? Is there anything you can share that can help me? I have a PGWP and am going to get married in a month. I hope to bring my wife over for a few months and then she has to go back to complete her studies for a couple of months, and that is wy I dont want to apply for a OWP immediately. I believe I can get a trv faster.
