Spouse status - Need help

Hello all,

If the spouse in in Canada, what would be the status if the principal applicant has just finished study & is applying for the PGWP? I understand that the spouse will be eligible for Open work permit only if PA has secured a job in NOC O, A or B so the status for the spouse, between applying for the PGWP and getting a job is a span that is not clear - please could someone help clarify?

If your spouse is in Canada she obviously got some type of visa - visitor, temporary resident visa, etc. Her status is whatever visa type she entered the country with.

Thanks Senorita.
He has entered the country as a visitor and the status converted to OWP - the duration is upto the expiry of the principal applicants study permit. When the PA is applying for PGWP, then the spouse will not have a status in that period hence my dilemma - would you know what the spouse should do then?

As long as the PA's study permit is valid when they apply for pgwp, the spouse's work permit is also valid and their status is "worker".

The PA's study permit is until July 30th 2012 & the spouse obtained the OWP until this period.
When the PA submit the application for PGWP , early or mid July & if the decision/approval is taken beyond the study permit expiry date i.e July 30th 2012, what will be the spouse's status in the country ? He is no longer with a status as the OWP also has expired.

Should the PGWP application include the Spouse renewal too? If yes, what will the status be (since the PA should work in skilled level O, A , B for the spouse to qualify for OWP) ?

You can try to call CIC for advice if you are not sure but my understanding is that once the study permit expires, the open work permit of the spouse also expires.

If the student already has a full time job or an offer of one and that is skilled, they could apply for the PGWP and the OWP for the spouse at the same time.

Thanks Leon - thats my understanding too.
But not always do we have a job offer in hand before applying for PGWP hence I was looking to get information on how they would treat the spouse status in that period until the PA can secure one. I did attempt to call CIC numerous times but its annoying to always end up on an automated machine & endless messages - will try again ! :(

Pick through the menu a couple of times and then try pressing 0. Then you should eventually get a person. It would also be an option for the spouse if they have a secure job and a happy employer to ask the employer to get an LMO and apply for their own work permit.
