Hi guys,
If you remember I had posted my issue about spousal sponsorship a while ago. My issue was that I landed in 2014 but just stayed in Canada for 2 months and moved to my country without getting my PR card. By TD I managed to enter Canada in 2016 for another 2 months and received my Card valid through 2016-2021 and then left Canada again. A week ago I entered Canada with some minor issues ( the first officer in the POE asked me why I was away for so long and I offered him my reasons and then he said you have to talk to a secondary officer in another salon in Toronto airport. Unlike the first officer, the second officer had a positive approach. He swiped my PR card and passport but didn't say anything suspicious or negative (although my landing date on the back of PR card was 2014 and I was way short of 730 days in the last 5 year period). He said everything is ok but that I needed to be cognizant of the 730 days to be met. He didn't say he would report me or handed me any departure order or anything. Now, my question is can I safely sponsor my wife who is out-land after I find a job to prove my true intentions to stay in Canada permanently? Is it possible that they have flagged my name for RO violation and reject my wife application once I apply? Any ideas? What is the safest thing I can do before I file my wife's sponsorship application? Please don't tell me to stay 730 days to meet the RO before I apply as it is emotionally impossible for me!

Have you reviewed the spouse sponsorship application package in particular the forms the sponsor needs to complete. This may be the challenge given you need to provide some information on your whereabouts last 5 years.

HI yes I know. But what if I prove them that I plan to stay forever now? I have a job and pay tax etc. And whats more, if it was a challenge wouldn't the officer at the airport warn me against that?

You have had this answered for you before, unfortunately asking again does not change the answer. As you were told in this thread, https://www.canadavisa.com/canada-immigration-discussion-board/threads/sponsorship-refusal.555301/#post-6876810 you needed to have spent 730 days in Canada from your landing date to meet the requirements for PR. As you were also told in this thread, https://www.canadavisa.com/canada-immigration-discussion-board/threads/sponsorship.548477/ you need to wait until you meet the requirements otherwise you risk losing your status as PR as well. Just because you got through immigration, does not mean you will get through with a spousal sponsorship as well.

Yes, that’s true. I think you’ve been given a chance to stay and get yourself back to a position of being within the requirements for PR. Which is great for you but because you aren’t currently meeting requirements, it may mean they won’t let you sponsor. A visa officer may not be as lenient as the CBSA officer. I think it’s ultimately your choice to take a chance with this since you seem very determined, but I think your odds of refusal would be quite high and you are putting your own PR at risk. Are you sure your wife couldn’t come another way? Express entry or as a visitor?

He meant that he wasn't reporting you. He did not in any way absolve you of not meeting the RO. If you apply to sponsor your spouse now, the app will be rejected and your PR status will be revoked.

What if she applies for a visitor visa? Is it risky as well? Can the IRCC find out again that I am in RO violation and revoke my status again?

She can sure apply for a visitor visa. But with a spouse in Canada, she needs to have proof of very strong tie to her homeland (job, properties). And very good travel history (visa required countries) to get visitor visa approved. There is a chance but approval rate isn't high.
