Spouse Sponsorship Living in USA

Hi there!

I need to know about the spouse sponsorship. Currently I am working in USA on H1 but my Canadian immigration is in pipeline. I have done with my medical, waiting for passport request. I want to sponsor my husband. I am thinking on several options, please help me finding a suitable possible solution,

1) Can I apply for sponsorship of spouse before my passport request? If yes, would it be harmful for my immigration process in any case? Secondly, how long would it take to get him here?

2) Or If I get the PR, Can I take the PR and then return to USA on my work, and then apply for sponsorship? Is it possible?

3) Or If I get the PR, and stays in Canada, then how long would it take to get my spouse here in Canada?

(My spouse is in Pakistan)

Hi,

1) You can not sponsor your husband until you officially become a permanent resident (PR) and is living in Canada as a PR. Unfortunately Pakistan has one of the longest average timelines for spousal sponsorship (almost 3 years).

2) Only a Canadian Citizen can sponsor someone while living outside Canada. Permanent Residents MUST live in Canada for the ENTIRE duration of the sponsorship process.

3) As mentioned in #1, the average time is almost 3 years (32 months). It can be faster depending on the application but it will still be a slow process unfortunately.

As kessio mentioned, it will be a longer processing time, but it won't necessarily be 32 months for you. It can be longer or shorter depending on the strength of your application. I've seen a lot of people here get a passport request 12 months after they first applied because they didn't have an interview or were missing any documents.

If you are in the process of gaining your Canadian PR now then you NEED to add your husband to your application now. You can either include him as non accompanying or accompanying but he NEEDS to be included. If you fail to do this and you land in Canada without listing him in your current application or having him examined you will forever exclude him from family sponsorship and the ONLY way he will ever be able to come to Canada after that will be by immigrating on his own without your sponsorship.

Also, if you include him now and have him examined and pay the fees it will be MUCH quicker than if you just include him as non accompanying and then sponsor him later.

Agreed 100%. You must include your spouse in your current PR application and it will be MUCH faster and easier to include him as accompanying than to include him as non-accompanying and have to go through the sponsorship process later.

May I know please how should I add him in my application? Since I have submitted my application and its in process. I am just waiting for my final passport request.

Email your VO immediately and inform them that you have married. They will tell you what they need to add your spouse. He will need to obtain the necessary PCCs and have a medical.
