Spouse Problem for my PR, PLease help!..

hi everyone,
i really need your need advice. pls help.. I would really appreciate it.

my case is, I am a PR and together with my daughter, we entered Canada last year, August 2012. My ex-husband soon entered Canada (in different destination) after 2 months., but we never met there.. I was the Principal Applicant under Skilled Worker Class.. During my application, our marriage was already in trouble, he have a new partner already and me have my new boyfriend too., it was later on too that we started our annulment. I didnt want to include him but I had no choice, All I was thinking is for me and especially my daughter's future, because the advice for me by my agent was better to include him so that I can meet the required points in order to apply. . That time of application, we are already separated, he live and work in different country and me working in different country too, but in papers, we are still legally married... When we got the application approved , I returned his passport to him without removing the visa sticker., but I did not inform and did not send to him his COPR because I didnt want him to come to Canada.. but after 2 months that me and my daughter arrived in Canada, I got news that he arrived there too and I dont know how. He stayed there for a month and went back to his work country.

Now here's the bigger story, just 2 days after we arrived in Canada, I learned that I was 5 weeks pregnant for my second child, with my boyfriend as the father.. I wanted to stay coz Maybe it was good for me because I got the chance to have my child be born in Canada and have a Canadian Citizen baby. My boyfriend applied for a tourist visa but he was refused. And since its only me and my eldest daughter (she's 7 1/2 y.o that time) there, it was too difficult for me as I was still adjusting to my new environment and especially to think that there's anybody to assist me during my pregnancy and once i give birth already, i became so depressed and so i decided to go back to my home country, that was in November 2012. Me and my daughter stayed in Canada for 3 1/2 months only. I gave birth to my 2nd child last April and Im planning to go back to Canada next year coz I dont want to loose my our residency, especially its for the future of my family. My annulment is approved by the court already last March but the marriage certificate with the annuled annotation is still in process in one of the government office here in my country, maybe I will be able to get it 2 months from now.. My boyfriend wants us to get married as soon as the annuled marriage certificate is released..

I really want to go back in Canada and to sponsor them later for us to settle there, but I want with my family (my 2 daughters and my boyfriend), but this worries me and I want to make sure if it is possible for me to sponsor them - so we can be together soon in Canada even if it is not in the same time, my boyfriend and my new daughter to join us in Canada.

My concerns are:
1. What shall I do to bring my boyfriend and my new baby to Canada and how? Is it possible for me to sponsor them?

2. Is there possibility for my PR to be revoked since my ex-husband and I are already separated and I being pregnant with my boyfriend as father the time we entered Canada? (and more -my new baby carried the surname of my boyfriend in the birth certificate).. What if the CIC says that they are going to revoke the visa because it was obtained in bad faith, would getting an immigration lawyer be a help so my visa will not be revoked?

3. How does the CIC notify a person concerned if they going to revoke somebody - is it by email or a letter with the address registered in their system?

You already asked this on 21st May. Didn't you like the answers you received? 1 & 2 have been answered by Scylla. 3. You would probably get a letter.

1. As explained in your other thread, sure - you can sponsor your boyfriend. But there's a decent chance this will create problems for your own PR status. To avoid these problems, your boyfriend should immigrate independently (e.g. as a skilled worker).
2. Yes - it's very possible your PR status will be revoked. It's extremely clear that you misrepresented yourself when you landed in Canada. So I don't see how a lawyer will be of any help.
3. Likely by mail.

There is another option.. Abandon your current PR and reapply as a complete family at some point in the future. This would avoid the possibility that you will get into trouble for misrepresentation with your existing situation. You made these choices and you have to work with the consequences. You knowingly cheated the system and I don't have a huge amount of sympathy. Sorry...

If that is the better way, then I would accept it. I didnt have the choice what happened to my first family, I hope u dont judge me. I am not asking for any sympathy, but I just really need the answer for what Im worrying, and that is enough for me to be thankful on you for.

1. What do you mean abandon my PR -- is it I have to wait for it to expire OR will I just send a letter to CIC and surrender my PR? and after abandoning it or revoking it, can / when can I re apply again?

2. I'm wondering, because as far I know, on the first entry, the visa on the passport and the COPR is needed. How did my ex-husband entered Canada even if he didnt have with with him his COPR?

3. If my visa is revoked, what will happen to the visa of my first daughter and especially my ex husband? will it be revoked too?Because if that is the case that if my PR will be revoked, I want my ex-husbands visa to be revoked too, I dont want him to benefit from what I applied for.

Your case is very complex. You should really consult with a good immigration lawyer at this point.

Forget about your ex husband. There is likely nothing you can do about his status.

You would still be in the same situation you are now even if your ex husband had never landed. The problem is not that he landed. The problem is that you lied when you landed. Don't blame your ex for the situation you are in now - the responsibility lies entirely with you.
