Congrats - yes its approved. This email basically should be or should contain your letter of introduction.

Thank you very much, the email contains a pdf file which tells that your Spouse work Permit has been approved, you will receive the work permit after landing in Canada, its a big 1-2 page letter and looks very much like an introduction letter only.


I am only worried as the passport is dispatched, will it have visa approved stamp for sure..??

You are most welcome. I guess you don't understand the process.

When a person applies from a non visa exempt country, they need two things a) Work permit to work in Canada and b) TRV to enter and exit Canada.

Work permit will be issued at the port of entry. But this Letter of introduction pretty much covers it.

Passport they ask for stamping of trv (which will be W-1 category in your case). If your work permit is approved, for sure your passport will be stamped with trv.

However, that trv only allows you to get in and out of Canada. It will be the actual work permit that lets you work there.

Hello Folks,

This are some of the helping points for applying Spouse Open Work Permit,

1.Strong Cover letter of Principal Applicant (don't forget to sign the letter, mention the reasons that you will return back to your home country)
2.Strong Cover letter of Spouse Applicant (don't forget to sign the letter, Also mention the clause -As per Regulation 205(C) (ii) – Section 5.38, C41, the spouse of a skilled worker working under NOC skills level 0, A or B, is eligible to apply for an Open Work Permit.)
3. All forms duly filled (don't forget to mention in the form that you are applying for Spouse Open Work Permit - very important to mention in the area where you specify open work permit)
4. Passport copies of both
5. Spouse Work Permit, Visa copy
6. Police Clearance Certificate of both
7. Marriage Certificate
8. Spouse Job Letter mentioning duties clearly and specifying your salary, NOC code very clearly and other information
9. Principal Applicant Job Letter mentioning duties clearly and specifying your salary and other information
10.Bank Statements 4 months
11.Joint Bank Account - (funds Approx CAD 15000$ should be good)
12.Spouse Account Bank Statement (Approx CAD 20,000$ should be good)
13.Spouse Tax returns
14.Financial Statement Letter (don't forget to sign the letter)
15.Spouse Advance Medical test
16.Birth Certificate
17.Principal Applicant passport should have spouse name and last name- not important but good to show

I don't know If I missed any documents, please free to add on the list

@Varun, i am glad i could be of help and i really appreciate you returning the favor and trying to help others. That is what the forum is meant for.

I would just add one clarification. It is always positive if you show proof of some additional funds.

However, if the principal applicant has a confirmed job offer from Canada that pays good enough to cover expenses, you don't need any amount of funds in bank.

You should still submit a bank statement as a proof of your income in home country. But having funds then is not a requirement.

E.g. i myself barely had less than 100k PKR (barely 1k CAD) in my account in the statement that i put forward. But i had a very good job offer and my statement showed my salary in home country being transferred for the last 6 months in my account. This was supplemented by pay stubs and experience letters.

So it serves as a strong tie to home country showing you are capable and actually earning that much in home country as well.

Same goes with at least 3 other friends of mine. None of them had ANY significant amount in their accounts. In proof of funds available for our families (spouses and kids), we were advised by company lawyer to put our annual salary from the jobs offered in Canada. All of these got approved pretty fast.

Hi All,

I have a Study Permit and a CO-OP permit till April 2015. My wife got a Open Work Permit based on my International Student Study Permit. She has been working and will be completing 1 year on Feb 2015. Can she apply for PR (Canadian Experience Class) after completion of 1 year Full time work ?

I have applied for Spouse OWP (paper application) on 13th November and i am eagerly waiting for the visa.

One of my friend had also applied for Spouse OWP in September, but hers got rejected last week :( stating the below reason.
'You have not demonstrated that you come within the exceptions under section 186 of the regulations
exempting you from the requirement obtain a work permit or that your employment in Canada comes
within the exceptions to section 203 of the regulations. As a result, your offer of employment must be the
subject of an economic effect determination before a work permit can be issued to you. Your employer in
Canada should contact he local office of the Department of Human Resources and Skills Development
Canada to begin this process.'

Her husband is studying in Canada and she had applied for SOWP.
How does this apply for SOWP? Any idea how she can reapply to make her case stronger?

Others also please help.

If she has been working in a SKILLED job NOC 0, A or B which should be verifiable on paper through her detailed job description issued by employer, she can.

However, by jan 2015 process would change some what because of Express entry program, which would basically still have CEC in it as one of the eligible programs but basically would process cases of those people faster which have a confirmed job in Canada

Hi,

Their documentation basically didn't show that she was eligible for SOWP. If her husband was working, it had to be a skilled job for her to be eligible for SOWP. If he is studying, it had to be an eligible university program and he must be actively continuing that for her to be eligible for SOWP.

This at times happen due to mistakes by CIC as well. First you should check her husbands credentials and exactly what was submitted, duration of study etc. Whether he studies at a college or a university in Canada, the length of program. If not clear still, then get gcms notes and find the exact reason on file, address that and reapply.

And in the invitation letter given by the university on behalf of her husband, it clearly mentions that 'Section 5.22 of OP12, spouses/common-law partners of fulltime
students (who are not themselves students) are eligible for open or open/restricted
work permits, depending on whether medical requirements have been met.'

Apart from that there is not option to fill for SOWP in the IMM1295E form that is submitted. Please let me know if any info can be added so that she can re-apply.
Also can you please give some information on how she can apply for GCMS notes? Thanks a lot for your help :)

I am glad i could be of help. What is the remaining duration of his program?

You would just specify Open work permit in SOWP and in employer details write "not applicable" or even better with "SOWP with spouse a university student" in the work permit application form.

Above should contain all info for getting gcms notes. But basically her husband present in Canada should apply for her after getting her authorization and would receive those with in a month's time frame.

Lately, i have seen CIC doing this quite often as a mistake or God knows what. But still, to be sure, its better to get notes and address the reasons mentioned, then reapply

Was anything missing in the above documents?
