Hi Navprateek,

I am sponsoring work permit application for my spouse(In India). I wanted to ask you what documents should I provide from here - Pay stubs, Lease agreement, Bank statement, Notice of assessment ? Are these sufficient or there is something extra too ?

Thanks for your help.
Hi,

From your end you would need to provide your pay stubs, bank statements and a letter from your employer confirming your NOC code job title and job duties and responsiblities. You have to change your martial status to married with CRA if not done yet. Notice of assessment will go as well.
Then our wife have to show her ties to home country, proof of marriage - marriage certificate and supporting documnets like chats and calls- We did attach our fb screenshots whatsapp chat.
Also I and my husband signed our power of attorney's under each other's name with an additional will of my father in law stating equal rights being their daughter inlaw.
Then for funds we showed +12000 cdn dollars in my husband's account.

Thats all I can think of so far. Hope it helps

Thanks Navprateek,

I have another question regarding document checklist IMM5488. On second page of this form, right after Marriage Certficate check box, it has four other check box (Proof indicating job offered, LMIA photocopy, Quebec resident and last Provinicial Nominee related). My question is - Should we just leave this check box empty because none of the condition applies as it is a Spouse work permit application?

Looks like CIC is already living up to the time lines committed for applications inside Canada since Jan 2016.

We applied for SOWP (extension) around mid Dec 2015. and got approval notification a couple days ago.

Since its only been 1.5 month and we weren't expecting it to be processed sooner (earlier processing time was around 120 days), I am inclined to believe they are covering the back log and would eventually get it to 1 month time frame.

Though our case might have been much simpler, extension on an existing SOWP with PA work permit extended already in the past.

@nurat,

Sure its just an observation, since I didn't know of any one yet who actually got it in shorter duration i.e. around a month or so.

Good luck to you, I believe you meant you applied in land from Canada.

All the best. But using a lawyer from Canada doesn't change the visa office. Since your spouse is in India it would most likely be processed there and processing time from Indian embassy would apply. Good luck

You could submit online application for both together although yours would be processed in Canada vs spouse's would be processed in the embassy catering his/her country of residence.

Hi FKL,

My husband's Sowp got refused today. I am a student with SP expiring Sep 2016. Applied sowp dec 28. The reason of refusal is not clear to me. It is mentioned in the "other reasons: you have not demonstrated that you meet the requirements of R205c(ii)." What is that?
There is no other reason mentioned on the refusal letter. Can you please make it clear for me.
Thanks
Raman

Hi Ramangill,

Sorry to hear that.

Here is a link to 205 C

http://laws-lois.justice.gc.ca/eng/regulations/SOR-2002-227/section-205.html

It seems to me there were some confusions in your application. Either it didn't properly demonstrated that you are a student at a full time college university program and hence you spouse is applying a dependent spousal open work permit or there is something else. They seem to be treating it under one of the exemptions in this section 205c instead of as a dependant SOWP.

Though I would also say that your expiry is just a bit above the 6 months mark but that alone in my opinion is not enough for a refusal.

I don't know what to say. Its probably too close to reapply because of your SP expiry. May be you should reapply once you get a renewal or a work permit and demonstrate your intention clearly.

Hi folks
I hope this page can help me in this tensed situation.i am on on pgwp having noc b job.i applied trv for my wife to bring her here. I applied from inside canada and it got refused for travel history, purpose of visit and financial assests.
Now i am thinking to apply for sowp rather than trv.what do you think which is better option?
Also one more question: if I apply for sowp, than do i need to fill trv application also to get visa?
Please help... It's urgent and tensed situation
Thanks
Gavy

Hey fkl,

Took the flagpole route today, got my WP. Thanks to you for all the guidance and support.

Now, can I somehow withdraw / cancel the online application and maybe get a full / partial refund? Any pointers to that?

Hi Nurat,

Congrats. I am not sure. I believe cbsa could have assisted you with canceling that if possible. But there is little chance otherwise. Still calling helpline or sending case specific inquiry shouldn't hurt.
