Hey guys,

Had a long discussion with a lawyer and my to be wife, since she has only 1 yr 10 months exp prior to starting full time blogging for various clients, she might face a problem/delay on getting a job here. Also, having the processing time into consideration she would be unable to help in anyway+ job wait period.

Considering all this, decided to get her here on student visa. I know it is costly but if its going to guarantee that we would stay together its acceptable. Money can be recovered down the line, time cant be. Also she gets to upgrade herself going to school here.

Going to get her in Winter 2017 intake.
Hope all goes well !!
If you dont mind asking whats the minimum qualification of your wife. And what was the year she left her studies?

well as of now a diploma should help her as the way things work in North America are different from back home in Media industry.

Lawyer said both the options would be ok. I know people who have gone back to school after doing a job for 3 - 4 years. My friend from college recently got a admission in George Brown. We were done with our Bach back home in 2012.

Hello everyone,

I wish to seek the advice of the members here about my situation.

I recently transitioned to a PGWP and need to get my spouse here.
An application for a visitor was filed in Aug 2015, so that my spouse could come to attend my convocation in Oct.
CIC asked for medicals- medical done and then in the meantime I ran out of my student status and the PGWP took forever to arrive.
CIC ultimately rejected it in Oct. The only reason marked was ' PURPOSE OF TRAVEL'
PGWP arrived in NOV.
Now, I have a skilled job in Government -temporary but extendable.
I am not sure if I can apply for OWP for my spouse with such a job rightaway or do I wait until I get an extension?
Can I apply for a visitor for my spouse and later change the status. My spouse will not begin working immediately.

Any guidance with this situation is highly appreciated.

Thanks and regards

As long as you have a job in NOC O, A,B,C and its a full time job which technically proves that your earning is around $29,00/month. Your spouse can apply for SOWP.

Thanks for the reply.

Yes, it is a full time job and is as a Program specialist with the provincial Govt. I do not know the exact NOC but definitely matches the standards set for spousal OWP eligibility.

As I gather from posts here, it takes a lot of time for spousal owp can I try a dependent without WP as I said that my spouse will not immediately start working. not sure... any comments/ advice please...

you can check your NOC code here http://www5.hrsdc.gc.ca/NOC/English/NOC/2011/html/Matrix.html. And for SOWP if your wife apply it from home country it doesn't take that long. You can check the open work permit processing times from CIC website. I will suggest to apply it from home country as she is not in Canada and through paper application.
I am not sure what you meant by dependant Visa. If you are taking about visitor visa I think its a risk as there'sone rejection already on a TRV.

I am in similar boat, I will suggest you wait for your extension first and then apply for her SOWP, dont go for visitor visa, to the best of my knowledge it has high chances of rejections, so wait first and collect all related documents from employer and then apply for her open work permit.

BTW, I just completed my studies, and have job offer in NOC A and I am going to apply my PGWP and my wife's Open work permit together online. I am very much hopeful she will get her SOWP this time: NOTE: 2x Visitor visa refused already, this will be 3rd application to CIC.
I hope it helps.

Question:

i am applying for SOWP. I am inside Canada with a valid work permit. My common-law partner has a work permit as assistant manager which falls under noc A. i want to transition from closed work permit to open work permit. i need to know if these are the only documents i need to send to cic:

1. IMM5556 checklist
2. IMM5710 application to change conditions
3. Statutory dec. of common-law
4. Fee payment
5. Photocopies of his current work permit and mine
6. Photocopies of our passports
7. Photocopy of his LMIA

Would appreciate a feedback :)

Hi everyone! My work permit as a Skilled Worker will be expires next month so my wife's Open Work Permit as well. My employer already applied a new LMIA and we apply a New Work Permit using my LMIA file number.
My question is:
A. When I should apply OWP for my wife?
B. Is it applicable the Implied Status to my wife?
C. What should I do to extend her stay also here in Canada while waiting for my New Work Permit?

Thank you very for help!
