Spouse Open Work permit / Visitor Visa

Hello,

I applied for a visitor visa (inland) and I’m waiting for the final decision. My partner just recieved his work permit ( NOC B ) and he would like to sponsors me as a common low. My question is, may I go already to the boarder to apply for a visa under common law sponsorship? Or do I have to wait until my visitor visa will be approved?

Just to clarify your work permit expired. Did you change your status online to visitor status before your work permit expired?

Did your partner declare you as common law in his work permit application? Do you have proof of the fact you are common law from the beginning of the 1 year period? Are you from a visa exempt country?

I did apply for extension of my stay as a visitor before my work permit expired. My partner declared me as common low in his work permit application. We have the proof. We are both from Czech Republic.

So yes you can flagpole to get a OWP As long as you bring all your documents and proof. Please make sure to check when borders accept people flagpoling. Some have specific hours.

Did you change your status to visitor before your work permit ended? What kind of work permit does your partner have?

As I said, I did apply to extend my stay in Canada as a visitor before my work permit expired but my application is still processing ( it may take upto 90 days to be approved ).
My partner has YP visa.

Sorry but I think you are incorrect that I can’t extend my stay as a visitor because I didn’t have visitor status before.
