Hi indianstudent

Good to hear that your wife got the OWP this time.
I am in the same situation as ur wife was. My husband is an International Student in Canada. I am currently in Bangalore and had applied for SOWP with all details and documents including his Visa details, His Passport details, His college invitation for me, my financial statement and personal assets etc.
However still got a rejection letter "You have not demonstrated that you come within the exceptions under section 186 of the
Regulations exempting you from the requirement to obtain a work permit or that your
employment in Canada comes within the exceptions to section 203 of the Regulations. As a
result, your offer of employment must be the subject of an economic effect determination before
a work permit can be issued to you. Your employer in Canada should contact the local office of
Service Canada to begin this process." and "your personal assets and financial status"

What other documents did you submit this time for your wife as you hv mentioned its processed within 2 days.. Kindly help!!! :(
Any other senior members please provide your input as well for SOWP with spouse Study permit.

For SOWP, is there any LMO to be mentioned? from the sources i hv read LMO is applicable only for work permit and not for Spousal OWP, Am i right?

When all the documents are submitted appropriately with good financial status, how can they refuse without giving proper information? I read we can send an email to Question @ cic.gc.ca as metioned by HossamHamed. Has anyone got any useful response from this ? Do we need to go through the same procedure again or cant we request them to re consider the application ?

Your inputs are appreciated!!

Thanks
Thats weird, Nameka. I would suggest you to apply for GCMS notes. The notes will clearly explain the reason. LMO or offer letter not required for SOWP. If you have a look at the Foreign Worker Manual http://publications.gc.ca/site/eng/439420/publication.html, You will get an idea of the rejection reasons.

But as I said, I applied online, and there was no option to upload more documents. They asked me only 4 documents they were mine nothing related to my husband.so what shall I do now. Shall I send a mail enquiry with husband's passport and visa. Or I should reapply for open work permit. Paper based or online. Please reply
Please do a paper based application. My online application was rejected too. Add all the documents, to prove that you relationship is genuine; your husband's status in Canada; and financial status. Everyones situation is specific. Add any document that may help them understand you case better. As i said the second paper based application we made was having documents that weighed 4 kgs.

Hi Indian Student,
I forgot to mention 1 very important detail. While i was still student and my wife was in in india in 2012 we tried her student visa in 2012 which was rejected. Will this affect our Application? Also, how do i answer these question IMM1295E.
- have you ever been refused visa or permit?
-Have you previously tried to enter or remain in Canada?

I appreciate your help! :)

HI Kumar,

Tick the check box and explain the reason in the box below. I'm not aware of your situation. Rejection of a study permit, is a rare case. Unless they have a very strong reason, i believe they don't reject study permit application. Anyway, explain your situation. Why you din't apply for her study permit again? (May be your wife pursued her education in India). Explain everything.

This will not affect your current application as long as you have clearly explained what happened and satisfy that you are eligible to apply again for a open work permit.

Dear Respected members

My wife's visitor visa was rejected for following reasons:

• Your travel history
• Your family ties in Canada and in your country of residence
• Limited employment prospects in your country of residence
• Your current employment situation
• Your personal assets and financial status

Now i will be applying for her OWP and i would like to write a letter in response to the rejection point. This is just a draft version and i would like to know your feedback. Please let me know you want me to edit or add anything

Your travel history
Dear Officer
I have travelled several times to State of Kuwait to visit my family and friends in last 5 years. All my stay was less than 6 months. I only stayed the duration of period permitted to me. Below is the all the entry and exit dates. I have also attach the relevant pages from the passport

-Limited employment prospects in your country of residence
- Your current employment situation
I have had several job offers to join corporate companies or as a lecturer of University. The reason I took the job is because this is one of the prestigious school . The teachers are selected after extensive screening process. I am proud to represent Mable Bear which is a Canadian Curriculum school which has a branch . Teaching has always been my passion. I also worked a teaching assistant in my University. In addition to that, this job allows me to focus on the current research I am doing (document attached)

Your personal assets and financial status
I just graduated from University 2013 and I have been in the job field for around one year. I have (approx. 15k CAD) in my account currently. My parents had around 5000 CAD in my name as fixed deposit so that I can use it in case of any need (document attach) and remaining 10000 cad is a result of my saving and gift during my marriage from my relatives. I do have parental properties (document attach) as well. As per my father, these properties will be eventually transferred to me and my sister's name and I will have to take care of it.

I do not how to deal with Your family ties in Canada and in your country of residence. Does it matter for OWP

THANK YOU EVERY ONE IN ADVANCE Smiley

Hey is it necessary to show his canadian bank statement as well?? We did nt submit any letter from from the employment as he has a.closed work permit so that itself has all the details. I submitted the following documents:-

Our marriage certificate
Our joint account bank statement with 6lakhs balance
His work pemit & visa
My LIC
His passport copy
My educational documents
Cover letter to the high commission
My recent work experience letter
My job offer letter
My oldest & newest salary slips

Are these many documents enough for my open work permit to get approved?

Hello
My wife applied for spousal open work permit. She had been rejected visitor visa and also spousal open work permit. So again she applied for SoWP.
This time she did online application. I am having Saskatchewan provincial nominee certificate. I joined her name on it. We applied for PR in June 2014. We both got medical done.
She put her medical in this spousal open we file. She applied on 3rd jan 2015. 5th jan 2015 she got updated status that medical passed. After that I didnot hear anything from cic . I am worried that what will happen next???
If they say medical passed , means she will get visa or not??
Please advice me.
Note: my job is under noc c category.

I guess they have rejected you application since your job is classified under NOC C. Usually it is easier 0, A or B. I would suggest you to get GCMS noted. To get a clear picture on why your spouse's application was refused. Your nomination should be of great help. and always i suggest to make paper based application if you are applying for outside Canada.

I wish your spouse gets visa this time. Mean while apply for GCMS. GCMS is worth more that $5.
